HomeMy WebLinkAbout16993 RES - 04/14/1982A RESOLUTION CALLING FOR AN ORIGINAL HEARING INTO CENTRAL POWER AND LIGHT COMPANY'S PROPOSED RATE INCREASE AND DECLARING COUNCIL'S INTENTION AT SUCH HEARING TO INQUIRE INTO THE STATUS OF THE SOUTH TEXAS NUCLEAR PROJECT AND LITIGATION AND WHETHER CENTRAL POWER AND LIGHT COMPANY SHOULD BE REQUIRED TO REIMBURSE RATE PAYER CITIZENS IN THE EVENT OF A COMPANY RECOVERY AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi emphatically affirms and insists upon its right under the Texas Public Utilities Regulatory Act and the City Charter to exercise original jurisdiction over the rates of public utilities within its city limits; and WHEREAS, pursuant to such statutory and charter authority, the City Council has, by previous ordinance, suspended the operation of the rate schedule proposed by Central Power and Light Company and authorized intervention jointly with other cities located in Central Power and Light Company's service area in Public Utilities Commission Docket No. 4400 concerning Central Power and Light Company's request to increase rates outside municipal boundaries. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRSITI, TEXAS: SECTION 1. That the City Council shall call and conduct within the time prescribed and in accordance with the procedures described in the Texas Public Utilities Regulatory Act and the City Charter an original hearing concerning Central Power and Light Company's proposed rate increase affecting rate payer -citizens and will expect and require attendance by appropriate Central Power and Light Company officials,. employees, and consultants to attend and present a full, complete, and satisfactory explanation and justificatiorrof said rate increase request, including the presentation of testimony and other competent evidence justifying the need for, and convincingly demonstrating the reasonableness of the proposed rate increase. SECTION 2. That it is the further intention of the City Council in conjunction with the aforesaid hearing to inquire into the sta+us of the South Texas Nuclear Project and the presently pending litigation involving Central Power and Light Company and other South Texas Nuclear Project partners against Brown and Root Company, including an inquiry into whether SEP 2 8 1(24 MICR.WILMED 16993 Central Power and Light Company should be required to reimburse rate payer -citizens in the event of a Central Power and Light Company recovery by settlement, order, or judgment against Brown and Root Company. SECTION 3: That upon written; request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for Central Power and Light Company and the rate paying citizens to know the Council's intention regarding the holding of such hearing and inquiry, such finding of an emergency is made and declared requiring suspension of the 'Charter rule as to consideration and voting upon ordinances and resolutions at three regular meetings so that this ordinance is passed andi shall take effect upon first reading as an emergency measure this )1,1- day of April, 1982.
