THROUGH NOON, JULY 27, 1982, AND GRANTING THE EXCLUSIVE USE OF THE MUNICIPAL PARKING LOTS TO THE FERIA HISPANICA SPONSOR FROM JULY 23, 1982, THROUGH SUNDAY, JULY 25, 1982, AND PERMITTING THE USE OF STREETS, SIDEWALKS, MEDIANS, SEAWALL AND FOUR MUNICIPAL LOTS FOR THE SAID FERIA HISPANICA SPONSORED BY THE DETICAN UNITY COUNCIL OF CORPUS CHRISTI; AUTHORIZING EXECUTION OF ATTACHED APPLICATION PERMIT. WHEREAS, the Mexican Unity Council of Corpus Christi, Texas has formulated plans for a Feria Hispanica to be held on Friday, July 23 through Sunday, July 25, 1982; and WHEREAS, the purpose of. said Feria Hispanica is to feature festival type booths and public entertainment sponsored by numerous Corpus Christi Civic Clubs and other organizations; and WHEREAS, the proceeds from the Feria Hispanica will be used for community and civic projects; and WHEREAS, the Mexican Unity Council of Corpus Christi, Texas, has requested that from -8 a.m., Monday, July 19, 1982, through 12 noon, Tuesday, July 27, 1982, certain blocks of North Shoreline Boulevard be closed to vehicular traffic; and Whereas, numerous civic and community groups will participate in the Feria Hispanica and have endorsed it; and WHEREAS, the City Council finds that the proposed Feria Hispanica will be in the interest of the public welfare; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That vehicular traffic be barred from the 1200 through 1600 blocks of North Shoreline Blvd. (both directions of travel) from 8 a.m., Monday, July 19, 1982 to 12 noon, Tuesday, July 27, 1982, so that the Mexican Unity Council of Corpus Christi, Texas can sponsor a Feria Hispanica and that 1701j. sy lgi4 000)633 said areas be barricaded to through traffic. It is directed that said areas be barricaded so as to allow emergency vehicles, such as fire, police and ambulance vehicles, to enter said areas in case of an emergency. It is further provided that vehicles of the City or Utility Companies furnishing public utilities, such as electricity, gas, water and telephone services to said areas, be permitted to enter said areas in case of an emergency. In addition to the above stated street closure by this ordinance, the sponsor of.the Feria Hispancia is granted the exclusive use of the sidewalks, medians, seawall, and four municipal parking lots adjacent to I.H. 37 access roads from 6 p.m. Friday, July 23, 1982, to midnight Sunday, July 25, 1982. Said areas are more fully described in Exhibit "A" attached hereto. SECTION 2. That in maintaining the street and public areas closed by this ordinance, the following regulations shall be observed. A. Liability insurance shall be furnished free of cost to the City, protecting against liability to the public and Feria Hispanica participants, including volunteer workers. Such insurance shall have policy limits of at least $500,000 for personal injury or death, $1,000,000 per occurrence, and $100,000 property damage, and shall name the City of Corpus Christi, Texas and the Mexican Unity Council of Corpus Christi, Texas as insured. A Certificate of Insurance in the above amounts shall be furnished the City Secretary and approved by the City Attorney with the application and permit provided for hereinafter. B. Any damage to City property will be restored by the sponsor of the aforesaid festival promptly after the close of the event. C. Any work which involves holes or other changes in the pavement, curbs, sidewalks, or seawall, must be approved by the Engineering & Physical Development Director and no such approval may be given if the work will require repair by the City. D. Appropriate permitsmust be obtained from the Alcoholic Beverage Commission for the sale of beer and.the City -County Health Department for the sale of foods. E. The construction work for displays within the areas affected by this ordinance shall be conducted in accordance with City specifications and in accordance with the electrical, plumping, and building construction codes of the City and after furnishing adequate assurance that all damages will be remedied by the permittee. F. No paint or markings shall be permitted which in any way oblit- erates or defaces any pavement markings heretofore existing for the guidance of any motor vehicle. G. After the Feria Hispanica is.overthesponsor will see that the streets are cleaned and restores to a condition to allow vehicular traffic to return to the streets at the expiration of the closure of the street. H. Within 60 days after the event ends, the sponsor shall remit 4 percent of the gross receipts derived from the festival to the City of Corpus Christi. SECTION 3. The City Manager is authorized to execute the attached application/permit for and on behalf of the City, which shall be filed for record in the Office of the City Secretary. SECTION 4. The provisions of this Ordinance relating to closing of the aforementioned streets are effective for the period beginning at 8 a.m. Monday, July 19, 1982 through noon Tuesday, July 27, 1982. The other provisions of this ordinance are effective from and after the date of publi— cation of the caption of this ordinance in the official publication of the City one time. However, no part of this ordinance shall be effective until the Manager and the authorized representative of the sponsoring Organization execute the aforementioned application/permit, and the Certificate of Insurance is approved and filed. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. THE STATE OF TEXAS COUNTY OF NUECES I APPLICATION/PERMIT KNOW ALL MEN BY THESE PRESENTS: Application The Mexican Unity Council of Corpus Christi, Texas in order to sponsor the Feria Hispanica on July 23, 24, and 25, 1982, hereby make application, acting by and through Mrs. Maria Del Rosario, Chairman, repre— senting the Mexican Unity Council of Corpus Christi, Texas, to the City of Corpus Christi, acting by and through, Edward A. Martin, its duly authorized representative, for the closing to vehicular traffic of the 1200 through 1600 blocks of North Shoreline Blvd., from 8 a.m. Monday, July 19, 1982, through noon Tuesday, July 27, 1982; and granting the exclusive use of the street, sidewalks, medians, seawall, and four municipal parking lots, to the sponsor of the Feria Hispanica from 6 p.m. Friday, July 23, 1982 through midnight Sunday, July 25, 1982. In consideration of the closing of said street and the use of said public areas, the sponsoring organizations hereby agree: 1. To allow emergency vehicles to use such areas as may be required in said areas. 2. To furnish liability insurance in the amounts of at least $500,000/$1,000,000/$100,000, a Certificate of which is attached hereto. 3. To restore any. damaged City property promptly after the date of the Feria Hispanica. 4. To obtain the approval of the Director of Engineering .& Physical Development for any work which requires holes or other changes in the pavement, curb, or sidewalk. 5. To obtain the appropriate beer and food permits 6. To construct all displays in accordance with the appropriate City Codes, and furnish adequate portable restrooms. 7. To provide certain barricades and not less than one uniformed security guard. 8. To not obliterate or deface any pavement markings heretofore existing for the guidance of motor vehicles. 9. To clean the area and restore it for use for vehicular traffic after the close of the Feria Hispanica. Sponsor agrees to pay the City half the cost of the City crew cleanup, i.e. hosing down, push-brooming sidewalks and streets, and running street sweeper, with the understanding that there will be no such cleanup charge if the sponsor has removed all loose debris from the permit area. 10. To remit 4 percent of the gross receipts derived from the festi- val to the City of Corpus Christi within 60 days after the Feria Hispanica ends. To close to vehicular traffic the 1200 through 1600 blocks of North Shoreline Blvd., from 8 a.m. Monday, July 19, 1982, through noon Tuesday, July 27, 1982. 2. To allow the use of the street, sidewalks, medians, seawall, and four municipal parking lots for the activities of the Feria Hispanica. 3.
