HomeMy WebLinkAbout17017 ORD - 05/05/1982LW:jkh:5-5-82;2nd 1 AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF GULFWAY SHOPPING CENTER BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1, 2, 3, AND 4, BEING OUT OF SECTIONS 12 AND 19, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "F -R" FARM -RURAL DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT ON TRACT 1, TO "A-2" APARTMENT HOUSE DISTRI-CT ON TRACT 2, TO "A-1" APARTMENT HOUSE DISTRICT ON TRACT 3, AND TO "R -7 -- MULTIPLE DWELLING DISTRICT ON TRACT 4; AND DECLARING AN EMERGENCY. „.. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Gulfway Shopping Center for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on April 28, 1982, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, hy motion duly made, seconded and carried, it was decgded by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning of Gulfway ShOpping Center more fully described hereinafter, be and the same is hereby changed from "F -R" Farm -Rural District to "6-4" General Business District on Tract 1, "A-2" Apartment House District on Tract 2, "A-1" Apartment House District on Tract 3, and "R-2" Multiple Dwelling District on Tract 4, said parcels or tracts being described as follows: stv 6 190 17017 MICROFILMED TRACT I Being 17.63 acres of land, more or less, out of Lot 8, Section 12 and Lot 1, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded ir Volume A, Pages 41, 42, 43, map records of Nueces County, Texas: BEGINNING at a point on the Northeast line of a 75.00 foot wide drainage right-of-way for the South corner of this tract from which corner the South corner of said Lot 1, Section 19 bears South 28° 57' 00" West 37.50 feet to a point on the center- line of said 75.00 drainage right-of-way and with said centerline South 61° 03' 00" East 260.00 feet; THENCE North 61° 03' 00" West, along said Northeast line of the 75.00 foot wide drainage right -of -way, - 385.21 feet to a point on the East right-of-way line of Airline Road for the West corner of this tract; THENCE North 02° 23' 00" East, along the East right- of-way line of Airline Road, parallel to the center- line thereof and 30.00 feet distant therefrom, measured at right angles thereto, 1,304.67 feet for the point of curvature of a circular curve to the right, a central angle of 23° 29' 51", a radius of 240.40 feet, a tangent distance of 50.00 feet and an arc length of 98.59 feet; THENCE with said curve to the right, 98.59 feet to its intersection with the Southwest line of the 40.00 foot wide Naval Air Station Railroad right-of- way for the North corner of this tract; THENCE South 610 03' 00" East, along said Southwest line of the Naval Air Station right-of-way, parallel to the centerline thereof and 20.00 feet distant therefrom, measured at right angles thereto, 621.50 feet for the upper East corner of this tract; THENCE leaving said Southwest line, South 02° 23' 00" West 750.00 feet for the lower East corner of this tract; THENCE South 28° 57' 00" West 580.00 feet to the POINT OF BEGINNING." TRACT II Being 10.54 acres of land, more or less, out of Lots 1, 2, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, pages 41, 42 and 43, Map Records of Nueces County, Texas; BEGINNING at a point on the Southwest boundary line of the 40.00 foot wide Naval Air Station Railroad right-of-way for the East corner of this tract from which corner The Meadows Unit 2, a map of which is recorded in Volume 45, page 244 of said Map Records bears South 61° 03 00" East 500.00 feet; THENCE South 28° 57' 00" West, leaving said above mentioned Southwest line, 830.46 feet for the South corner of this tract; THENCE North 61° 03' 00" West 420.00 feet for the West corner of this tract; -2- THENCE North 28* 57' 00" East 147.96 feet for a corner of this tract; THENCE North 02° 23' 00" East 'a point on the aforementioned Station Railroad right-of-way THENCE South 61' 03' .00" East 743.00 feet, more or less, to 750A0 feet, more or less, to Southwest line of the Naval Air for the North corner of this tract; , along said Southwest line, the POINT OF BEGINNING. TRACT III Being a 9.12 acre tract of land, more or less, out of Lots 1, 2, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, pages 41, 42 and 43, Map Records of Nueces County, Texas: • BEGINNING at a point on the Northeast boundary line of a 75.00 foot wode drainage right of way, at its intersection with the Southeast boundary line of said Lot 2 for the South corner of this tract from which corner the South corner of said Lot 2 bears South 28° 57' 00" West 37.50 feet; THENCE North 61° 03' 00" West, along said Northeast drainage boundary line, parallel with the Southwest boundary line of said Lot 2, same being the centerline of said 75.00 foot wide drainage right of way thereof and 37.50 feet distant therefrom, measured at right angles thereto, at 660.00 feet, more or less, pass the boundary line of said Lots 1 and 2, in all a distance of 920.00 feet, more or less, for the West corner of this tract; THENCE North 28° 57' 00" East 432.04 feet, more or less, for the North corner of this tract; THENCE South 61° 03' 00" East 920.00 feet, more or less, to a point on the Northwest subdivision line of The Meadows Unit 2, a map of which is recorded in Volume 45, page 244, of said map records for the East corner of this tract; THENCE South 28° 57 00" West, along said subdivision line, 432.04 feet, more or less, to the POINT OF BEGINNING. TRACT IV Being 9.61 acres of land, more or less, out of Lot 2, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, map records of Nueces County, Texas: BEGINNING at a point on the Southwest right-of-way line of the 40.00 foot wide Naval Air Station Railroad right- of-way for the North corner of The Meadows Unit 2, a map of which is recorded in Volume 45, Page 244 of said map records and the East corner of this tract from which corner the East corner of said Lot 2 bears North 28* 57' 00" East 20.00 feet; THENCE South 28° 57' 00" West, along the Northwest sub- division line of said The Meadows Unit 2, 830.46 feet, more or less, for the South corner of this tract; • THENCE North 61' 03' 00" West 500.00 feet for%the West corner of this tract; -3- Thence North 28" 57' 00" East 830.46 feet to a point on said Southwest Naval Air Station Railroad right-of- way for the North corner of this tract; THENCE South 61' 03' 00" East, along said above mentioned Southwest right-of-way, parallel to the centerline thereof and 20.00 feet distant therefrom, measured at right angles thereto, 500.00 feet to the POINT OF BEGINNING." SECTION 3. That the official zoning Map of the City of Corpus Christi, Texas, be, and ti -:e same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to tire, except as herein changed, shall remain in full force and effect. ' SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare am emergency due to the need for the immediate and equitable institution of zoning changes to promote the health, safety and economic development of the City,such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolu- tions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the6 day of Lqat,, 1982.
