HomeMy WebLinkAbout17039 ORD - 05/12/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.37 SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS 3.82 ACRES, MORE OR LESS, OUT OF ANNEX NO. 1, NUECES RIVER IRRIGATION PARK; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Comnission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on May 12, 1982, at Regular Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "6-4" General Business District should be granted to the tract of land consisting of approximately 3.82 acres of land, being described as being out of Annex No. 1, Nueces River Irrigation Park, in Nueces County, Texas; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That:the permanent zoning of "6-4" General Business District be granted to the aforesaid described and hereinafter more fully described parcel or tract of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would ivitocutiNED SEP 2 8 igg4 17039 serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, is hereby amended by adding a new subsection, 31-5.37, said new subsection to hereafter read as follows, such zoning classi- fication of the hereinafter described property to be effective upon annexation: "Section 31-5.37 The following described tract of land shall be zoned and classified '8-4General Business District: A parcel or tract consisting of approximately 3.82 acres of land out of Annex No. 1, Nueces River Irrigation Park, Nueces County, Texas: METES AND BOUNDS DESCRIPTION FOR 3.82 ACRE TRACT OUT OF ANNEX NO. 1, NUECES RIVER IRRIGATION PARK, NUECES COUNTY, TEXAS. Being a tract of land situated in Nueces County, Texas, North of F. M. Road No. 624, containing 3.82 acres, more or less, out of Annex No. 1, Nueces River Irrigation Park, as shown on map of record in Volume "A", Page 55 of the Map Records of Nueces County, Texas, also being a portion of a 37 acre tract described in deed of record in Volume 322, Page 416 and in Volume 541, Page 495 of the Deed Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows, to -wit: Beginning at a point in the present City Limits Line of Corpus Christi, Texas, whence the intersection of the original center line of F. M. Road No. 624 and the present center line of Main Canal (as measured March 10, 1979), bears S 09°-57' E, a distance of 320.8 feet and S 84°-09' E, a distance of 484.5 feet, for the SE corner of this tract and the point of beginning; THENCE N 09°-57' E, a distance of 813.6 feet to a point marked by a 5/8 inch iron rod for the NE corner of this tract; THENCE N 84°-09' W, parallel to northerly boundary line (present) of the right-of-way of F. M. Road No. 624, a distance of 205.2 feet to a point marked by a 1/2 inch iron pipe for the NW corner of this tract; THENCE S 09'-57' W, a distance of 813.6 feet to a point in the present City Limits Line of Corpus Christi, Texas, for the SW corner of this tract; THENCE S 84°-09' E, along the present City Limits Line of Corpus Christi, Texas, a distance of 205.2 feet to the point of beginning, and containing 3.82 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall 'remain in full force and effect. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on, the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning designation, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration ard voting upon ordinances and resolutions at three -regular meetings so that this ordinance is passed and shall take ef ect upon first reading as an emergency measure this the A,/ day of , 19302/ .
