HomeMy WebLinkAbout17041 ORD - 05/12/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 27, SUPPLEMENTARY HEIGHT, AREA, AND BULK REQUIREMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, a public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on April 13, 1982, at Special Council meeting of the City Council in the City Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amend- ments would best serve the public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • " SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the changes hereinafter set out. SECTION 2. That Article 27, Supplementary Height,.Area, and Bulk Requirements, Section 27-3, Modification of Area Regulations, Subsection 27-3.04 be amended by adding one new paragraph to be numbered 27-3.04.06 to read as follows: 27-3.04.06 For residential structures of two stories or less within a water oriented subdivision due to the openness created by the various waterways within the subdivision the re- quired side yard may be modified to deviate from the requirements of Article 24 of this ordinance as follows: (1) A residential structure and any accessory structure may be located adjacent to the side lot line pro- vided a minimum 10 foot side yard is maintained along the remaining side lot line; and (2) Provided an appropriate fire resistant wall with- out openings as defined by the City Building Code is provided along the zero lot line. sEp 2 8 1984 17041 A water oriented subdivision is a subdivision along any bay, gulf, cove, canal, lagoon, or pass, and shall be a marina type development which shall include canals, channels, and waterways adjacent to at least 20 percent of the lots within the subdivision. SECTION 3. That Article 27, Supplementary Height, Area, and Bulk Requirements, Section 27-3 Modification of Area Regulations, Subsection 27-3.03 be amended by adding one new paragraph to be numbered 27-3.03.06 to read as follows: 27-3.03.06 For lots within a water oriented iubdivision due to the openness created by the various waterways within the sub- division the front yard may be reduced to not less than 10 feet, provided this reduced front building line is indicated on the face of the recorded plat of the sub- division. Private garages, which open onto the street, detached or attached to the main building shall maintain a yard of 20 feet from such garage entrance to the street right-of- way. A water oriented subdivision is a subdivision along any bay, gulf, cove, canal, lagoon or pass and shall be a marina type development which shall include canals, channels and waterways adjacent to at least 20 percent of the lots within the subdivision SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by amending the Zoning Ordinance as aforementioned, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon reading as an emergency measure this the A2-, day of ATTEST: VP7/11"( City Secretary , 19 APPROVED: ii6570F MAY, i471fit .
