HomeMy WebLinkAbout17050 ORD - 05/26/1982mb;5/26/82;2nd AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE BY AMENDING CHAPTER 36, PARKS, RECREATION, CULTURAL AND LEISURE TIME ACTIVITIES, ARTICLE I, IN GENERAL, AUTHORIZING OVERNIGHT CAMPING AT NUECES RIVER PARK ON A THREE-DAY PERMIT BASIS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the Corpus Christi City Code be amended by amending Chapter 36, Parks, Recreation Cultural and Leisure Time Activities, Article I, In General, by adding to Section 36-9 the following: A. Add to Definitions under subsection (a) the following: Nueces River Park - 30 -acre park located at Nueces River and Highway 77. B. Add to subsection "(b) Prohibitions" the language "or the Nueces River Park" said subsection to hereafter read as follows: "(b) Prohibitions. It shall be unlawful for any person to camp overnight or build campfires on any of the publicly -owned areas within the Corpus Christi Improvement.District, the Shoreline -Ocean Drive Parkway, or the Nueces River Park." C. Amend subsection (c), Exceptions, Nueces River Park, to: hereafter read as follows: "(c) Exceptions. A person may camp overnight at Corpus Christi Beach Park located at the northernmost end of Corpus Christi Beach only within those areas designated by posted signs for a period not to exceed three days. A person may camp overnight in the municipal parking lots adjacent to the Coliseum, Exposition Hall, and Bayfront Arts & Science Park, provided that the person is in a self-contained camping vehicle and is using the premises in conjunction with a lease of any such facilities." A person may camp overnight at Nueces River Park only if authorized by the Director of the Park and Recreation Department via a camping permit, to be prescribed by the director. Said permit shall be valid for three days only, and may be extended for one similar period of time upon approval of the Director of Park and Recreation. D. Add a new subsection (d), "Park Regulation," to read as follows: 17050 tAICROflINED s.,p g 104 "(d) The Director may prescribe rules governing camping and overnight use of the parks described in this section, including but not limited to, limitation of the number of campers and campsites, designation of areas in which camping will be permitted, limitation of the number of persons who may occupancy a campsite, the manner of accepting applications for camping permits, limitation of noise, prohibition of firearms, regulation of animals, and regulation of activities potentially inconsistent with park purposes. The Director shall have proprietary managerial authority over said parks, and he or his designated subordinates may direct any individual to cease an activity inconsistent with park purposes or with the rights of other park users, and, if such warning is not heeded, may order such individual to leave the park. Such an order will constitute revocation of the individual's camping permit, if any. Any conduct which constitutes a violation of the Texas Penal Code, an ordinance of this City, the rules promulgated by the Director, or a direction to cease under this ordinance shall constitute grounds for expulsion from the park. Any peace officer may arrest or issue a citation for a violation of state law or City ordinance committed in his presence, in the parks described herein. All provisions of this ordinance, and any rules or directives by the Director, shall be applied equally and uniformly to all persons. Nothing herein shall be applied so as to violate any individuals right of free speech or expression under law." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. This ordinance shall take effect and be in full force and effect from and after its publication. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of 1 this ordinance stating in substance the purpose, intent and effect of the aforesaid'Ordinance. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action in the best interest of the public welfare and the need for the immediate and efficient utilization of the City's resources which demands the prompt attention of the Council, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 26th day of May, 1982.
