. AN ORDINANCE
CLOSING AND ABANDONING A 10 -FOOT UTILITY EASEMENT, A
5 -FOOT PORTION OF WHICH IS OUT OF MT. VERNON SUBDIVISION
NO. 3 AND A PORTION IS OUT OF PADRE -STAPLES MALL; CLOSING
AND ABANDONING TWO 10 -FOOT UTILITY EASEMENTS PREVIOUSLY
RETAINED THROUGH THE CLOSING OF MT. VERNON DRIVE; CLOSING
AND ABANDONING ALL OF JANET DRIVE FROM THE NORTH RIGHT OF
WAY LINE OF MT. VERNON DRIVE TO THE SOUTH RIGHT OF WAY
LINE OF McARDLE ROAD AND MT. VERNON DRIVE FROM LENORA
DRIVE TO JANET DRIVE, SUBJECT TO CONDITIONS SET FORTH
HEREINAFTER.
WHEREAS, there exists a ten -foot utility easement, of which five
feet is out of Mt. Vernon Subdivision No. 3 and recorded in Volume 19, page
84, Nueces County Map Records, and five feet of which is out of Block 1,
Padre -Staples Mall and recorded in Volume 33, page 86, Nueces County Map
Records; and
WHEREAS, there exist two ten -foot utility easements previously
retained through the closing of Mt. Vernon Drive by Ordinance No. 9393; and
WHEREAS, it has been determined that it is feasible and
advantageous to the -City of Corpus Christi to abandon said easements, more
fully described hereinafter; and
WHEREAS, notice of the time and place for holding a hearing
concevring the closing of Janet Drive from the north right of way line of Mt.
Vernon Drive to the south right of way line of McArdle Road and Mt. Vernon
Drive from Lenora Drive to Janet Drive, situated in the City of Corpus
Christi, was given by publication and mailed to the last known addresses of
the owners of property abutting the public way proposed to be closed and
thereafter, pursuant to said notice, public hearing was held at Regular
Council Meeting by the City Council of the City of Corpus Christi on May 5,
1982, in accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing
that a portion of the aforesaid streets, proposed to be closed, are not
needed now, nor will they be within the foreseeable future needed for public
streets, and that the same should revert to the abutting property owners,
said closing to be subject to conditions set forth hereinafter:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That the ten -foot utility easement, partially out of
the Mt. Vernon Subdivision and partially out of the Padre -Staples Mall,
hereinafter more fully described, be closed and abandoned to the property
owners:

Said closing to be subject to applicant paying cost of capping four -inch
water line, abandoning, rerouting and furnishing alternate easements, if
required, for two-inch gas line and plugging the eight -inch sanitary sewer.
SECTION 2. That two parallel ten -foot utility easements previously
retained by closure of a portion of Mt. Vernon by Ordinance No. 9393 be and
the same are hereby closed and abandoned subject to applicant paying costs of
capping six-inch water line and abandoning or rerouting four -inch gas line to
include furnishing alternate easements, if required, said easements to be
abandoned being described as follows:

easement adjacent to the Southwest boundary line of Lot 11,
Block 11, Mt. Vernon Subdivision Unit 3, a map of which is re-
corded in Volume 19, Page 84, Map Records of Nueces County, Texas,
said 10.00 foot wide utility easement obtained by the closing of
that portion of Mt. Vernon Drive by City Ordinance No. 9393:
BEGINNING at the South corner of said Lot 11 for the East
corner of this easement;
THENCE South 29°00'30" West, with the 'Southeast boundary line
of Mt. Vernon Subdivision Unit 3, 10.00 feet for the South corner
of this easement;
THENCE North 60°57'30" West, parallel with the Southwest boun-
dary line of said Lot 11 thereof and 10.00 feet distant therefrom,
measured at right angles thereto, 9/.26 feet to a point on the
existing Southeast right-of-way line of Mt. Vernon Drive for the West
co.rner of this easement and the point of curvature of a circular
curve to the 'left whose radius point bears North 69°58'24" West
34.59 feet and has a central angle of 36°00'06", a radius of 34.59
feet, a tangent distance of 11.24 feet, and an arc length of 21.73
feet;

ture of a circular curve to the left whose radius point bears North
74°01'30" East 30.91 feet and has a central angle of 44°59'00", a
radius of 30.91 feet, a tangent distance of 12.80 feet and an arc

THENCE with said curve to the left, along the Southwest boun-

SECTION 3. That there are hereby closed and abandoned to the
abutting property owners two 10 foot utility easements previously retained
through the closing of a portion of Mt. Vernon Drive by Ordinance No. 9393,
said easements being described as follows:

utility easement obtained by the closing of that portion of Mt.
Vernon Drive by city Ordinance No. 9393:
BEGINNING at the South corner of said Mt. Vernon Subdivision
Unit 3 for the South corner of this casement;
THENCE North 60°57'30" west, with the Southwest subdivision
line of said Unit 3, 131.42 feet to a point on the existing South-
west right-of-way line of Mt. Vernon Drive for the West corner of
this easement and the point of curvature of a circular curve to the
left whose radius point bears North 29°02'30" East 34.59 feet and
has a central angle of 44°41'30", a radius of 34.59 feet, a tan-
gent distance of 14.22 feet and an arc length of 26-98 feet;
THENCE with said curve to the left, along said right-of-way,
26.98 feet for the North corner of this easement;
THENcE South 60°57'30" East, parallel with said Southwest sub-
division line of Unit 3 thereof and 10.00 feet distant therefrom,
measured at right angles thereto, 107.09 .feet to a point on the
Southeast subdivision of said Unit 3 for the East corner of•this
easement;
THENCE South 29°00'30" West, with the Southeast boundary line
of said Mt. Vernon Subdivision Unit 3, 10.00 feet to the PLACE OF
BEGINNING.

Said closing to be subject to the applicant paying costs of capping six-inch':
water line and abandoning or rerouting four -inch gas line to include

SECTION 4. That the 10 -foot utility easement in Block 10, Mount
Vernon Subdivision Unit 3, is hereby closed, said easement being described
as follows:

of which is recorded in Volume 19, Page 84, Map Records of Nueces

BEGINNING at a point on. the Southwest right-of-way line of
McArdle Road same being the Northeast boundary line of Lot 22
of said Block 10 for the East corner of this easement from which
corner the common front corner of Lots 1 and 22, Block 10 bears
North 60°59'30" West 5.00 feet;
THENCE with the Southeast boundary line of said 10.00 feet
wide easement, South 29°00'30" West 30.00 feet for the point of
curvature of a circular curve to the right which has a central
angle of 05°51'00", a radius of 3,070.83 fee, a tangent distance
of 156.91 feet and an are length of 313.54 feet;

THENCE with the continuation of said Southeast boundary line,
along said curve to the right, crossing through Lots 22, 21, 20, 19,
18 and 17, 313.54 feet for the point of tangency and the point of re-
verse curve to the left which has a central angle of 05°51'60", a
radius of 3,624.83 feet, a tangent distance of 185.21 feet and an
arc length of 370.10 feet;
THENCE with the Southeast boundary line of said 10.0 foot wide
utility easement, along said curve to the left, crossing through
Lots 16, 15, 14 and 13, 370.10 feet for the point of tangency;
THENCE South 29°0030" West, with said Southeast line, 30.80
-feet to a point on t:he Northeast right-of-way linc. of Mt. Vernon
Drive same being the Southwest boundary line of Lot 12 for the
South corner of this easement;
THENCE North 60°5730" West, along the Northeast right-of-way
line of Mt. Vernon Drive, at 5.00 feet pass the common front corner
of Lots 11, 12 and continuing along the Southwest boundary line of
said Lot 11, in all a distance of 10.00 feet for the West corner
of this easement;
THENCE with the Northwest boundary line of said 10.00 foot
wide utility easement, North 290030" East 30.80 feet for the
point of curvature of a circular curve to the right which has a
central angle of 05°51'00", a radius of 3,634.83 feet, a tangent
distance of 185.72 feet and an arc length of 371.12 feet;
THENCE with the continuation of said Northwest boundary line,
along said curve to the right, crossing through Lots 11, 10, 9,
8 and 7, 371.12 feet for the point of tangency and the point of
reverse curve to the left which has a central angle of 05°51'00",
a radius of 3,060.83 feet, a tangent distance of 156.39 feet and an
arc length of, 312.52 feet;
THENCE with the Northwest boundary line of said 10.00 foot wide
utility easement, along said curve to the left, crossing through
Lots 6, 5, 4, 3 and 2, 312.52 feet for the point of tangency;
THENCE North 29°00'30" East, with said Northwest line, 30.00
feet to a point on said Southwest right-of-way line of McArdle
Road same being the Northeast boundary line of Lot 1 for the North::
corner of this easement;
THENCE South 60°6930" East, along the Southwest right-of-way
line of McArdle Road, at 5.00 feet pass said common front corner of
Lots 1 and 22, Block 10, in all a distance of 10.00 feet to the
PLACE OF BEGINNING.

SECTION 5. That all of Janet Drive from the north right of wax
line of Mt. Vernon Drive to the south right of way line of McArdle to include
Mt. Vernon Drive from Lenora Drive to Janet Drive, as further described
herein and as filed in the Map Records of Nueces County, in Volume 19, page
84, be closed and abandoned to the abutting property owners:

BEGINNING at the South corner of said mt. Vernon Subdivision
(nit 3, thence North 60°57'30" West, with the Southwest -subdivi-
sion line of said Unit 3, 231.42 feet to the "Point of Beginning"
of this description;
THENCE North 60°57'30" West, with the continuation of said
Southwest subdivision line, 282.23 feet for the West corner of
this tract and the point of curvature of a circular curve to the
left whose radius point bears North 29°02'30" East 34.59 feet and
has a central angle of 134°56'51", a radius of 34.59 feet, a tan-

THENCE with said curve to the right, along the existing right-
of-way line of Mt. Vernon Drive as obtained by City Ordinance No.
9393, 81.51 feet to the POINT OF BEGINNING, containing 1.19 acres
of land_

Said closing to be subject to the following conditions:
(a) construction plans being submitted to the Director of Engineering and
Physical Development showing physical improvements needed to effectively
close Mt. Vernon Drive and Janet Drive to traffic, all at applicant's
expense.
(b) Capping and abandoning of four inch gas and six inch water lines in
Mt. Vernon Drive and furnishing of alternate easements, if required, all at
applicant's expense.
(c) Block 11 and Lots 12 through 22, Block 10 of Mt. Vernon No. 3 to be
replatted per City Platting Ordinance standards. (See attached metes and
bounds descriptions and exhibits for Janet Drive and Mt. Vernon closures.)
The abandonment of all easements described hereinabove shall not
become effective nor be considered valid until the need for utility services
of all types has ceased and utility cut-off requests have been made as
required for all services along and within all easement described for closure
and/or abandonment within this ordinance.

seconded the motion that the o dinance read on two of three readings on
May 12 and May 19, 1982, respectively, be amended prior to the third and
final 'reading, by adding to the ordinance closing and abandoning utility
easements and a portion of Janet Drive and a portion of Mt. Vernon Drive,
a new Section 4 and renumbering the present Section 4 as Section 5, so as
to abandon a 10 -foot utility easement in Block 10, Mount Vernon Subdivision
Unit 3, said easement being described in Section 4, said new Section 4 to
hereafter read as follows:
SECTION 4. That the 10 -foot utility easement in Block 10, Mount
Vernon Subdivision Unit 3, is hereby closed, said easement being described
as follows:
PIELDNOTES for the abandonment of a 10.00 foot wide utility
easement out of Block 10, Mt. Vernon Subdivision Unit 3, a map
of which is recorded in Volume 19, Page 89, Map Records of Nucces
County, Texas:
BEGINNING at a point on the Southwest right-of-way line of
McArdle Road same being the Northeast b•oundary line of Lot 22
of said 14lock. 10 for the East corner of this easement from which
corner the common front corner of Lots 1 and 22, Block 10 bears
North 6059'30" West 5.00 feet;
THENCE with the Southeast boundary line of said 10.00 feet
wide easement, South 2900'30" West 3.0.20 feet for the point of
curvature of a circular curve to the right which has a central
angle of 05'5100", a radius of 3,070.83 feet, a tangent distance
of 156.91 feet and an arc length ot 313.54 feet:
THENCE with the continuation of said Southeast boundary line,
along said curve to the right, crossing through Lots 22, 21, 20, 19,
18 and 17, 313.54 feet for the Point of tangency and the point of re-
verse curve to the left which has a central angle of 0551'00", a
radius of 3,629.83 feet, a tangent distance of 185.21 feet and an
arc length of 370.10 feet;
• THENCE with the Southeast boundary line of said 10.0 foot wide
utility easement,. along said curve to the left, crossing through
Lots 16, 15, 19 and 13, 370.10 feet for the point of tangency;
THENCE South 29°00'30" West, with said Southeast line, 30.80
feet to a point on the Northeast right-of-way linc of Mt. Vernon
Drive same being the Southwest boundary line of Lot 12 for the
South corner of this easement;
THENCE North 60°57'30" West, along the Northeast right-of-way
line of Mt. Vernon Drive, at 5.00 feet pass the common front corner
of Lots 11, 12 and continuing along the Southwest boundaru line of
said Lot 11, in all a distance of 10.00 feet for the West corner
of this easement;
THENCE with the Northwest boundary line of said 10.00 foot
wide utility easement, North 29°00'30" East 30.80 feet for the
point of curvature of a circular curve to the right which has a
central angle of 05°51'00", a radius of 3,634.83 feet, a tangent
distance of 185.72 feet and an arc length of 371.12 feet;
THENCE with the continuation of said Northwest boundary line,
along said curve to the right, crossing through Lots 11, 10, 9,
8 and 7, 371.12 feet for the point of tangency and the point of
reverse curve to the left which has a central angle of 05°51'00",
a radius of 3,060.83 feet, a tangent distance of 256.39 feet and an
arc length of 312.52 feet;
THENCE with the Northwest boundary line of said 10.00 foot wide
utility easement, along said curve to the left, crossing through
Lots 6, 5, 4, 3 and 2, 312.52 feet for the point of tangency;
THENCE North 29°00'30" East, with said Northwest line, 30-00
feet to a point on said Southwest right-of-way line of McArdle
Road same being the Northeast boundary line of Lot 1 for the North
corner of this easement;
THENcE South 60°5930" East, along the Southwest right-of-way
line of McArdle Road, at 5.00 feet pass said common front corner of
Lots 1 and 22, Block 10, in all a distance of 10.00 feet to the
