WATSON AND COMPANY BY GRANTING A SPECIAL COUNCIL PERMIT FOR DEVELOPMENT OF AN APARTMENT PROJECT ON 10.68 ACRES OUT OF LOTS 9 AND 10, SECTION 12, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACT, MORE PARTICULARLY DESCRIBED ON THE SITE PLAN ATTACHED; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of J. L. Watson and Company for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday May 26, 1982, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for development of an apartment project on 10.68 acres of land out of Lots 9 and 10, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, more fully described as follows: FIELDNOTES for 10.68 acres of land out of Lots 9, 10, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest boundary line of a 75.00 foot wide drainage right-of-way for the North corner of this tract from which corner the East corner of Lot 1, Block 8, Wooldridge Creek Unit 1, a map of which is recorded in Volume 44, Pages 114, 115 bears with said right-of-way North 61°0040" West 209.91 feet; SEP 2 8 1984 „,,,600A9i 17057 THENCE South 61°0040" East, along the aforementioned right-of-way, 790.00 feet for the East corner of this tract from which corner the West right-of-way line of Airline Road bears South 61°00'40" East 25.93 feet; THENCE South 29°0000" West 579.97 feet for the point of curvature of a circular curve to the right which has a central angle of 90°0000, a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE with said curve to the right, 15.71 feet for the point of tangency; THENCE North 61°0000" West 679.43 feet for the point of curvature of a circular curve to the right which has a central angle of 25°14'01", a radius of 235.92 feet, a tangent distance of 52.81 feet and an arc length of 103.90 feet; THENCE with said curve to the right, 103.90 feet for the West corner of this tract; THENCE North 29°00'00" East 567.31 feet to the POINT OF BEGINNING. and as more fully described on the site plan, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit 'A ,and subject to all other conditions of "A-1" Apartment House District and "R-16" One Family Dwelling District. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved althe 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient adminstration of City affairs by granting the aforesaid zoning -2- change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the ,074 day of , 19 Aab44 it Secretary APPROV D: :2' DAY OF , 19g1/: J.
