HomeMy WebLinkAbout17063 ORD - 06/02/1982jkh:6-1-82;lst AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS TO CONDEMN FEE TITLE TO A CERTAIN TRACT OF LAND OWNED BY CARMEN VILLARREAL, SAID CONDEMNATION BEING NECESSARY FOR THE WOOLDRIDGE- STAPLES DRAINAGE OUTFALL PROJECT, AND AUTHORIZING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO ACQUIRE PARCELS 19, 20, 21, 22 AND 23 FOR THE SAID PROJECT; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for and on behalf of the City of Corpus Christi certain parcel or tract of land described as follows: Being a rectangularly shaped tract of land out of Lots A, B, C, D, E, Block 27, Bass Subdivision, as shown by map of record in Volume 7, page 17, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point being the north corner of said Lot A; Thence S. 60° 55' 30" E., 663.05 feet to a point being the east corner cf this tract and said Lot E; Thence S. 29* 04' 30" W., along the easterly boundary of said Lot E, 55.00 feet to a point; Thence N. 60° 55' 30" W., 663.05 feet to a point; Thence N. 29° 04' 30" E., 55.00 feet to the point of beginning and containing 0.837 acres, more or less. and WHEREAS, the Wooldridge -Staples Drainage Outfall Project requires the acquisition of the aforesaid parcel of land; and WHEREAS, record title to the aforesaid tract appears to be in the following: Carmen Villarreal; and WHEREAS, the City of Corpus Christi is unable to arrive at an agree- ment with the said owner and claimant as to the price and value of said parcel or tract, and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that said parcel or tract of land described be acquired through the exercise of the City's power of eminent domain for said public purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of 17063 MICROFILMED 190 acquiring the aforesaid parcel or tract of land and premises, excluding mineral interests, for use by the City for the Wooldridge -Staples Drainage Outfall Project. SECTION 2. That the City Attorney is hereby authorized and directed to institute proceedings against the said property and against all persons who appear to have an interest therein and to proceed with said condemna- tion suit to final conclusion and to obtain possession and title to said property for use in the Wooldridge -Staples Drainage Outfall Project. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for acquiring the aforesaid parcel or tract for the construction of the Wooldridge -Staples Drainage Outfall Project so that the project can continue on a timely basis, such finding of an emergency is made and declared requir- ing suspension of the Charter rule as to consideration and voting upon ordi- nances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 2nd day of June, 1982.
