HomeMy WebLinkAbout17066 ORD - 06/02/1982AN ORDINANCE CLOSING AND ABANDONING THE 20 -FOOT ALLEYS IN BLOCKS 12 AND 13, ALL OF WEST ELLIFF STREET FROM AVENUE C TO AVENUE B, AND ALL OF AVENUE B FROM WEST ELLIFF STREET TO WEST BUCKHORN STREET, ALL PROPERTIES IN CALALLEN TOWN - SITE SUBDIVISION AS SHOWN BY PLAT IN VOLUME 1, PAGE 44, NUECES COUNTY MAP RECORDS, SAID CLOSURES BEING SUBJECT TO CONDITIONS MORE FULLY SET FORTH HEREINAFTER; AMENDING ORDINANCE NO.9808 PERTAINING TO CLOSURE OF AVENUE 13; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place :For holding a hearing concern- ing the closing of the 20 -foot alleys in Blocks 12 and 13, all of West Elliff Street from Avenue C to Avenue B, and all of Avenue B from West Elliff Street to West Buckhorn Street, being in Calallen Townsite Subdivision, 'as shown by plat in Volume 1, page 44, Map Records of Nueces County, Texas, was given by publication and mail to the last known addresses of the owners of property abutting the public way proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council on May 26, 1982, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the said public ways, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public right of way, and that the same should revert to the abutting property owners, subject to certain conditions, more specifically outlined hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 20 -foot alleys in Blocks 12 and 13, all of West Elliff Street from Avenue C to Avenue B, and all of Avenue B from West Elliff Street to West Buckhorn Stree, all being in the Calallen Townsite Subdivision as shown by plat in Volume 1, page 44, Map Records of Nueces County, Texas, be and the same are hereby closed for use as public ways and shall revert to the abutting property owners subject to the following condi- tions: A. That the aforesaid closures be subject to the retention of drainage easements in a portion of the alley in Block 13 and Avenue B as shown on Exhibit A; 17066 B. That a portion of Lots 10, 11 and 12 of Block 13 be replatted to face West Buckhorn Street, as shown on Exhibit B; and C. That Lots 5, 6, 11 and 12 of Block 12, and Lots 1, 2, 3, 4, 7, 8 and 9, Block 13, fractional lots 1, 2, 3, 4, 5, 6 and 7, Block 17, and all of the remaining part of Block 18 be replatted at the expense of the abutting property owners, all of said Properties being in the Calallen Town - site Subdivision. SECTION 2. That Ordinance No. 9808, pertaining to the closure of Avenue B, passed and approved on June 17, 1970, be and the same is hereby amended,and the terms thereof are superseded by the conditions and terms of this ordinance. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the hereinabove described public rights of way and the need for the immediate and efficient utilization of the City's resources which demands the prompt attention of the Council, such finding of an emergency is made and declared requiring suspension of the Charter rule as to considera- tion and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the .206/ day of June, 1982.
