AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH
TULOSO MIDWAY INDEPENDENT SCHOOL DISTRICT REGARDING
PAVEMENT ON HAVEN DRIVE AND WATER IMPROVEMENTS;
APPROPRIATING $21,840; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized to
execute an agreement with the Tuloso Midway Independent School District which
provides for the City to pay a certain portion of the cost of pavement on
Haven Drive, from McKenzie Road to 2,550 feet west adjacent to the Morgan
School Tract and which provides for the City to pay the cost of oversizing a
water line to be installed across McKenzie Road along the Morgan School
Tract, all as more fully set forth in the agreement, a substantial copy of
which is attached hereto and made a part hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $21,840 of which
$14,230 is out of the No. 220 Street Bond Fund, Project No. 220-77-65, Haven
Drive, and $7,610 is out of the No. 141 Water Fund Reserve, Department 361,
Activity 541.99.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
executing the aforementioned agreement so that the street and water line
improvements adjacent to the Morgan School Tract can be developed, such
finding of an emergency is made and declared requiring suspension of the
Charter rule as to consideration and voting upon ordinance or resolutions at
three regular meetings so that this ordinance is passe; nd shall
upon first reading as an emergency measure this the day of
1982.

AGREEMENT
THE STATE OF TEXAS I
COUNTY OF NUECES I
This Agreement is entered into between the City of Corpus Christi,
Texas, hereinafter called "City", and Tuloso Midway Independent School District,
hereinafter called "Developer", and pertains to the City's share of the oversize
costs for street improvements on Haven Drive and water improvements coincidental
with the development of Morgan School Tract Subdivision.
WHEREAS, the Developer desires to construct street and water improvements
adjacent to the Morgan School Tract bounded by McKenzie Road and Haven Drive,
and;
WHEREAS, the City desires to have the street and water improvements con-
structed to specifications above the requirements of the City Platting Ordinance;
NOW THEREFORE, the City and Developer agree as follows:
A. Street Improvements
1. Developer will construct street improvements on and along Haven Drive,
from McKenzie Road to 2,550 feet west, said construction to be contracted for and
financed by Developer.
2. City agrees to reimburse Developer its share of the above described
construction cost for five (5) feet of pavement width plus engineering as is
shown on the attached Construction Cost Estimate, marked Exhibit "B", and Map,
marked Exhibit "A", attached hereto and made a part hereof. For purposes of this
Agreement, the amount of the City reimbursement to the Developer shall not exceed
Fourteen Thousand, Two Hundred Thirty and no/100 Dollars ($14,230.00).
B. Water Improvements
1. The Developer will construct 1,200 linear feet of 12 -inch water line in
lieu of the 8 -inch water line required by the City Platting Ordinance along McKenzie
Road as shown on Exhibit "C" attached hereto and made a part hereof. This con-
struction will be contracted for and financed by the Developer.
2. The City agrees to reimburse the Developer as its oversize share for
the cost of the above stated construction, plus 711% Engineering, the sum of
Seven Thousand, Six Hundred Ten and no/100 Dollars ($7,610.00), as shown by
attached Exhibit "D".

C. General Provisions
1. Reimbursement for street and water improvements will be made by the
City to the Developer upon completion and acceptance of the subdivision improve-
ments by the City. The actual reimbursement will be adjusted according to the
actual construction material quantity after completion of the work.
2. The Developer agrees to indemnify the City against any claims arising
as a result of this project.
3. This agreement shall be executed in duplicate, both of which shall be
considered one instrument. When both of the duplicates have been executed by
the City, and at least one duplicate has been executed by the Developer, this
agreement shall become effective and shall be binding upon and shall inure to
the benefit of the parties and their respective heirs, successors and assigns.
