AUTHORIZING ACQUISITION OF PARCELS 19 THROUGH 23 FOR
THE WOOLDRIDGE-STAPLES DRAINAGE OUTFALL PROJECT, PHASE I,
AND APPROPRIATING $13,850 FOR SAID ACQUISITION; AND DECLAR-
ING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute documents necessary for the acquisition of a drainage easement,
Parcels 19 through 23, hereinafter more fully described, from Carmen
Villarreal for the Wooldridge -Staples Drainage Outfall Project, Phase 1,
Project No. 295-70-66, said tract or parcel being described as follows:
Being a rectangularly shaped tract of land out of Lots A, B,
C, D, E, Block 27, Bass Subdivision, as shown by map of re-
cord in Volume 7, Page 17, Map Records, Nueces County, Texas,
and more particularly described by metes and bounds as follows:
Beginning at a point being the north corner of said Lot A;
Thence S. 60° 55' 30" E., 663.05 feet to a point being the
east corner of this tract and said Lot E;
Thence S. 29° 04' 30" W., along the easterly boadary of said
Lot E, 55.00 feet to a point;
Thence N. 60° 55' 30" W., 663.05 feet to a point;
Thence N. 29° 04' 30" E., 55.00 feet to the point of beginning
and containing 0.837 acres, more or less.
A substantial copy of the said drainage easement is attached hereto and
made. a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated out of the No. 295
Storm Sewer bond Fund the sum of $13,850 for acquisition of the aforesaid
parcels.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
acquire said drainage easement to promote the immediate construction and
development of improvements within the City which will further the City's
health, safety and economic development, such finding of an emergency is
made and declared requiring suspension of the Charter rule as to consideration

and voting upon ordinaces or resolutions at three regular meetings so that
this ordinance is passed and shall take effect upon first reading as an emer-
gency measure this

THAT Carmen Villarreal of the
County of Nueces, State of Texas, for and in consideration of the sum
of Thirteen Thousand Eight Hundred Fifty Dollars & no cents ($13,850.00)
to me (us) in hand paid by the City of Corpus Christi, Dienes County,
Texas, the receipt of whiCh is hereby acknowledged, have granted and
conveyed, and by these presents do grant and convey unto the City of
Corpus Christi, Texas, a municipal corporation day incorporated under
and by virtue of the laws of the State of Texas, its successors and
legal representatives the free and uninterrupted use, liberty, privi-
lege, and easement of going in, on, over, under, and along a certain
tract of land situated in Ifteces County, Texas, and being described as
follows:

cord in Volume 7, Page 17, Map Records, Nueces County,
Texas, and more particularly described by metes and bounds
as follows:
Beginning at a point being the north corner of said Lot A;
Thence S. 60° 55' 30" E., 663.05 feet to a point being the
east corner of this tract and said Lot E;
Thence S. 29° 04' 30" W., along the easterly boundary of said
Lot E, 55.00 feet to a point;
Thence N. 60° 55' 30" W., 663.05 feet to a point;
Thence N. 29° 04'30" E., 55.00 feet to the point of beginning
and containing 0.837 acres, more or less.
A man of which is marked "Rxhibit A", and attached hereto and made a
parthereof for all purposes.
Together with the free ingress, egress, and regress to and for the City
of Corrus Christi, Texas, -for the purpose of. constructing a public drain-
age facility, and for the purposes of maintaining, servicing, repairing,
and insnecting said public drainage facility under, on, and along said
tract.
TO HAVE AND TO HOLD, all and singular, the rights and privileges afore-
said to the City of Corpus Christi, Texas, its successors and legal re-
presentatives, for the proper use as a drainage easement and drainage
right-of-way, for so long as used for such purpose, and if the use for
said easement and way of said uses be ever abandoned, then in that event,
the aforesaid rights and privileges shall cease.
ALL FENCES AND IMPROVEMENTS WILL BE RELOCATED OUTSIDE OF EASEMENT AREA AT
THE EXPENSE OF THE CITY OF CORPUS CHRISTI..
DIRT EXCAVATED FROM SUBJECT EASEMENT AREA WILL BE RETAINED BY THE GRANTOR
AND THE GRANTEE WILL SPREAD SAID DIRT OVER LOW AREAS ON GRANTOR'S PROPERTY
AS DESIGNATED BY GRANTOR.
IT IS UNDERSTOOD THAT THIS EASEMENT IS BEING CONVEYED TO THE CITY UNDER
THREAT OF EMINENT DOMAIN PROCEEDWS.
