HomeMy WebLinkAbout17100 ORD - 06/30/1982jkh:5-29-82;lst AN ORDINANCE CLOSING AND ABANDONING A 5 -FOOT UTILITY EASEMENT IN LOT 35, BLOCK 2, BRECKENRIDGE UNIT 1, AS RECORDED IN VOLUME 46, PAGES 131-132, MAP RECORDS, NUECES COUNTY, TEXAS, SUBJECT TO REPLATTING; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 5 -foot wide utility easement in Lot 35, Block 2, Breckenridge Unit 1, as recorded in Volume 46, pages 131-132, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi tb abandon the said utility easement, subject to replatting of the lot at the owner's expense: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the more fully described five-foot wide utility easement in Lot 35, Block 2, Breckenridge Unit 1, be and the same is hereby closed for public use and every municipal purpose, subject to replatting of Lot 35 by the owner at the owner's expense: Being a 5 -foot wide strip of land out of Lot 35, Block 2, Breckenridge Unit 1, a subdivision as shown of record in Volume 46, pages 131-132, Map Records, Nueces County, Texas, and further described as follows: Beginning at a point being the west corner of said Lot 35 and west corner of this tract, said point lies on the north right of way of 50 -foot wide Vail Street; Thence N. 28° 28 00" W. along the westerly lot line of said Lot 35 112.50 feet to a point 7.50 feet southwesterly from the north corner of said Lot 35; Thence S. 61° 32' 00" 5.00 feet to a point for the east corner of this tract; Thence S. 28° 28' 00" W. along a line 5.0 feet northeast from and parallel to the westerly lot line of said Lot 35, 112.50 feet to a point on the north right of way of said Vail Street; Thence N. 61° 32' 00" W. along said right of way 5.0 feet to the point of beginning and containing 0.0129 acres, more or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, 1_7100 sgp 2 8 1984 ()FILMED tui word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by closing the aforementioned utility easement, such finding of an emergency is made and declared requir- ing suspension of the Charter rule as to consideration and voting upon ordi- nances or resolutions at three regular meetings so that this ordinance is passed and shall take e ect upon first reading as an emergency measure this the 30Pday of , 1982.
