HomeMy WebLinkAbout17111 ORD - 07/07/1982jkh:7-2-82;lst AN ORDINANCE CLOSING AND ABANDONING UNUSED PORTIONS OF RIGGAN STREET, ELIZABETH STREET AND 19TH STREET RIGHTS OF WAY, MORE FULLY DESCRIBED HEREINAFTER; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of unused portions of street rights of way of Riggan Street, Elizabeth Street and 19th Street, more fully described hereinafter, was given by publication and mailed to the last known addresses of owners of property abutting the public ways proposed to be Closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on June 23, 1982, in accord- ance with the provisions of the City Charter; and 6 WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of right of way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights of way, and that the same should revert to the abutting property owners, save and except that there shall be retained utility easements as described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the unused portions of Riggan Street right of way, described and illustrated by Exhibits A and B attached hereto, be closed and abandoned for use as public right of way except that the northern 40 feet of the west unused portion of Riggan Street be retained as a utility easement; that Elizabeth Street right of way described and illustrated by Exhibits C and D attached hereto, be closed and abandoned for use as public right of way except that a 20 -foot wide utility easement, centered on the 10 -inch sanitary sewer line, adjacent to Lot 3, Block 1, Stewart Newman Addition, be retained as a utility easement; and that 19th Street right of way described and illustrated on Exhibits E, F, G, H and J attached hereto, be closed and abandoned for use as public right of way, and that the unused portions of the above-named streets revert to the abutting property owners. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid SP 281 127111 or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council.that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the hereinabove described public rights of way and the need for the immediate and efficient utilization of the City's resources which demands the prompt attention of the City Council, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 7 day of July, 1982.
