HomeMy WebLinkAbout17123 ORD - 07/14/1982AN ORDINANCE ESTABLISHING A CABLE COMMUNICATIONS COMMISSION, PROVIDING RULES FOR MEMBERSHIP AND ORGANIZATION, AND OUTLINING ITS DUTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 2, Administration, Article X, Miscellaneous Boards, Commissions and Committees, of the Code of Ordinances of the City of Corpus Christi be amended by adding "Division 8 Cable Communications Commission" to consist of the following: Section 2-300. Establishment. There is hereby created a Cable Communications Commission for the City. The Cable Communications Commission shall consist of seven (7) residents of the City of Corpus Christi appointed by the City Council. The membership of the Commission shall consist of one representative of a local governmental entity, one representative of higher educational institutions, one representative of other public educational entities including local public independent school districts, one representative of religious institutions and three representatives of the public at large. No person or employee with ownership interest in a cable communications franchise granted by the City shall be eligible for membership on the Commission. Each Commission member shall be at the time of appointment, or shall become within thirty (30) days after appointment or the availability of cable service, a subscriber to a cable communications system holding a franchise in the City. SECTION 2-301. Membership and Organization. All members of the Cable Communications Commission shall serve for three (3) year terms or until their successors are appointed and qualified; provided: 17123 sgp 2 8 1984 MICROFILMED however, that two (2) members shall be initially appointed for three (3) year terms. Two (2) members shall be initially appointed for two (2) year terms and three (3) members shall be initially appointed for one (1) year terms. Immediately upon organization of the Cable Commission, the City Council shall select from the membership a chairman, whose term shall be one (I) year. The City Council shall re -appoint the chairman annually. A vice-chairman shall be elected by the Commission and shall serve a term of one (1) year. Such chairman and vice-chairman may be re -appointed and re-elected. The Commission shall meet at the call of the Chairman and at such other times as may be provided by its rules. The majority of members shall constitute a quorum, provided that the majority vote of such quorum shall be necessary for the adoption or approval of any matters before the Commission. All meetings of the Cable Communications Commission shall be public except for matters which qualify for a closed session in accordance with state law. The minutes of said Cable Communications Commission shall be available for examination in the office of the City Secretary during regular business hours. The members of the Commission shall serve without compensation. Section 2-302. Duties. The Cable Communications,Commission shall have the following powers and duties: (A) To advise the City Council on adherence to the provisions of any franchise agreement approved by the City Council and recommend regulations not inconsistent with the terms of such franchise. (13) To encourage, develop and promote the use of access channels to cable communications and to assure that access channels offer a diversity of programming and . services to subscribers. (C) To work with access user groups to develop rules and regulations which are not in conflict with the terms of the franchise agreement. (D) To develop sources of funding, including but not limited to private foundation or federal or state grants to further community programming. (E) To conduct evaluations of the cable system and to review and audit reports submitted to the City by a franchisee. (F) To advise the City Council on rate adjustment requests. (G) Report annually to the Council in writing giving a comprehensive and current view of the cable communications in the City and recommending any appropriate actions including amendments to the ordinance or franchise agreement. (H) To advise the City Council on future applications for franchises. (I) To acquaint itself with technological and service developments in •the cable communications industry and determine with the franchisee what system enhancements should be pursued in maximizing benefits to be derived for the community. ; That the foregoing ordinance wu read for t first timedad passed to its second reading on this the :ID day of , 190Z— , by the following vote: Luther Jones Betty N.
