AN ORDINANCE
ORDERING AN ELECTION TO BE HELD IN THE CITY OF CORPUS
CHRISTI, TEXAS, ON THE 14TH DAY OF AUGUST, 1982, UPON
THE QUESTION OF ADOPTING AN AMENDMENT TO THE CITY
CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS, AND THAT
SUCH ELECTION SHALL BE HELD JOINTLY WITH THE CORPUS
CHRISTI INDEPENDENT SCHOOL DISTRICT ELECTION; SETTING
FORTH THE PROPOSITION TO BE VOTED ON AT SAID ELECTION;
AND PROVIDING FOR SEVERABILITY.
WHEREAS, the City Council has received a petition with sufficient
signatures required under Article 1170, Vernon's Annotated Civil Statutes
of Texas, calling for a Charter amendment election on the issue of
compulsory binding arbitration to resolve collective bargaining impasses
between the City and the Firefighter and Police Officers Associations and
has been ordered to call such an election by writ of mandamus issued by the
148th District Court of Nueces County, Texas:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That an election is hereby ordered to be held on
Saturday, August 14, 1982, in the City of Corpus Christi, Nueces County,
Texas, at which election shall be submitted to the voters who are qualified
to vote under the Constitution and laws of the State of Texas, the
following amendment to the City Charter of the City of Corpus Christi,
Texas:
PROPOSITION NUMBER 1
Shall the City Charter be amended to add a provision
which reads as follows:
AN ARTICLE AMENDING THE EXISTING COLLECTIVE BARGAINING
AGREEMENTS BETWEEN THE CITY OF CORPUS CHRISTI AND THE
ASSOCIATION RECOGNIZED AS THE EXCLUSIVE BARGAINING
AGENTS FOR FIRE FIGHTERS AND POLICEMEN, TO PROVIDE FOR
ARBITRATION AS A METHOD TO RESOLVE COLLECTIVE
BARGAINING IMPASSES BETWEEN THE CITY AND SUCH
ASSOCIATIONS.
The existing collective bargaining agreements between the City of Corpus
Christi and the Associations recognized as the exclusive bargaining agents
for the firefighters and policemen pursuant to Vernon's Annotated Civil
Statutes of Texas, Article 5154c-1 et. seq. shall be amended to include the
following Article:
In the event that the City of Corpus Christi and the Association have
reached an impasse as defined under Vernon's Annotated Civil Statutes of
Texas, Article 5154c-1, Section 9; and in the event mediation invoked under
Section 9 of said Article has failed to resolve the impasse, or one of the
parties has refused to mediate; then the following impasse procedure shall
prevail:

1. Either party to the dispute, after written notice to the
other party containing specifications of the issue or issues in dispute,
may request arbitration; provided however a party shall not request
arbitration more than once during any fiscal year. In the event that one
party makes a request for arbitration, then both parties shall submit all
issues in dispute to arbitration. The issues to be submitted to
arbitration shall be all matters which the parties have been unable to
resolve through collective bargaining.
2. Arbitration invoked under this Article shall be conducted
by the parties pursuant to the procedures, duties, requirements and rights
set forth in Vernon's Annotated Civil Statutes of Texas, Article 5154c-1,
Sections 9, 10, 11, 12, 13, 14, and 15; except that Vernon's Annotated
Civil Statutes of Texas, Article 5154c-1, Section 10(b) shall .be
specifically excluded from this Article and not apply herein.
3. If requested by either party, it shall be the duty of the
arbitration board convened under this Article to render an award that takes
into consideration the City's ability to pay, the probability of a tax
increase resulting from an award, and the impact of such tax increase on
the welfare and interest of the City.
4. If any provision of this Article or the application of such
provision to any persons or circumstances is held invalid, the remainder of
the Article or the application of such provision to persons or
circumstances other than those to which it is held invalid shall not be
affected thereby.
SECTION 2. The.ballots for said election shall be in such form
as to permit voters to vote "YES" or "NO." The proposition shall appear on
said ballot as follows:
Shall the City Charter be amended to add a tirovision
amending existing Fire and Police collective bargaining
agreements to require, upon request of either party,
YES that the City and the employee associations be
compelled to submit to a panel of three (3)
NO arbitrators, for final decision, all issues concerning
wages, salaries, and other terms and conditions of
employment on which the City cannot agree with the
exclusive bargaining agent for City firefighters and
all such issues on which the City cannot agree with the
exclusive bargaining agent for City police officers?
SECTION 3. The election shall be held pursuant to Article 1170,
R.C.S., Texas, and the general laws of Texas pertaining to election insofar
as such are applicable hereto. The polls shall be open from 7:00 a.m. to
7:00 p.m. on the date of said election, and voting machines shall be
employed at the election herein ordered pursuant to the Texas Election
Code, V.T.S., Article 7.14, as amended.
SECTION 4. The Corpus Christi Independent School District
Election shall be held jointly with an election of the City of Corpus
Christi; the shared expenses of such elections shall be borne by the City
of Corpus Christi and by the Corpus Christi Independent School District in
proportion to the number of voting precincts utilized by each; a single
ballot form containing all of the offices to be voted on and each
proposition to be voted on shall be used at each joint polling place; the
poll lists, tally sheets and return forms for such elections may be
combined and multiple sets of the joint returns of such election may be
made by the election officials holding such elections; one set of all
returns and tally lists shall be delivered to the City Council of the City
of Corpus Christi; and one set of such returns and tally lists shall be
delivered to the Board of Trustees of the Corpus Christi Independent School
District; and only one set of election precincts, voting places and
election officials (hereinafter designated) shall be used in the conduct of
such joint election.
SECTION 5. Bill G. Read, whose office is situated at the Office
of the City Secretary, Third Floor, City Hall, 302 S. Shoreline Drive,
Corpus Christi, Texas, is hereby appointed Election Manager and Judge of
said election, and he is hereby authorized and directed to make all
necessary arrangements for the holding of said election in accordance with
and subject to the laws of this State, and Bill G. Read, J. M. Pearce, and
Ed Schroeder are appointed to hold such election in accordance with the
laws of this State.
SECTION 6. Voting machines shall be used for the conduct of said
election on election day and for conducting absentee voting, except that
for absentee votes cast by mail, paper ballots shall be used. Absentee
voting in person shall be conducted in the lobby of City Hall, 302 S.
Shoreline Drive, Corpus Christi, Texas, from 8:00 a.m. to 5:00 p.m., Monday
through Friday, beginning on Monday, July 26, 1982 and ending cTuesday,
August 10, 1982. The following officials shall conduct the absentee
voting:

SECTION 7. A special canvassing board shall be used to count the
absentee ballots, and the following persons are hereby appointed to serve
as such special canvassing board, to -wit:

SECTION 8. The City Secretary is directed to post and publish
such election notices as are required by the Election Laws of the State of
Texas.

SECTION 10. By approving and signing this ordinance, the Mayor
officially confirms as his action all matters recited in the ordinance
which by law come within his jurisdiction.
SECTION 11. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance shall be
held invalid or unconstitutional by final judgment of a court of competent
jurisdiction it shall not affect any other section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph, subdivision,
clause, phrase, word or provision hereof be given full force and effect for
its purpose.
