HomeMy WebLinkAbout17140 RES - 07/21/1982A RESOLUTION AMENDING RESOLUTION NO. 16079, PASSED BY THE CITY COUNCIL ON FEBRUARY 25, 1981, CONCERNING SALE OF CERTAIN SURPLUS PROPERTY TO LULAC FOR HOUSING FOR THE ELDERLY AND HANDICAPPED, SO AS TO SUBORDINATE THE CONDITION OF SALE TO ANY INTERESTS OF THE DEPART- MENT OF HOUSING AND URBAN DEVELOPMENT; AND DECLARING'. AN EMERGENCY. WHEREAS, the City Council by Resolution No. 16079, pass'ed,and approved on February 25, 1981, declared 'a 3.40 acre site, known as the Old Incinerator Site, to be surplus to the needs of the City except fors.'a section on the southeast portion to be reserved for use by the City, and reaffirmed its intention to sell the said site to LULAC for development of Housing for the Elderly and Handicapped; and WHEREAS, it is the desire of the City Council that another provision be added to said Resolution No. 16079 providing that the sale of the 3.40 -acre site be subordinated to any interests of the Department of Housing and Urban Development: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Resolution No. 16079, passed on February 25, 1981, be amended so as to add a paragraph, to be numbered 4, reading as follows: 4) THAT the condition of sale of certain surplus property to LULAC requiring development of the property as housing for the elderly and handicapped be subordinated to any interests of the Department of Housing and Urban Development, its successors or assigns. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need'for the immediate and efficient utilization of the City's resources which demands the prompt attention of the Council, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this the day of July, 1982.
