BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a contract with Sherrod Construction Company to provide for Sherrod to install a sanitary sewer line in Wooldridge Road and to provide for the City's participation in a portion of the alt of oversize/overdepth of the said line not to exceed $125,560. A substantial copy of said contract is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated out of the No. 250 Sanitary Sewer Bond Fund the sum of $125,560 applicable to Project No. 250-77-40, Wooldridge Road Truck --London House Apartments, to supplement previous appropriations. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to expedite the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to considera- tion and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the c;22 day of July, 1982. Sherrod and John K. Sherrod, hereinafter called "Developer", and pertains to the City's share of the cost for improvements as set forth in the Platting Ordinance for oversizing of the Wooldridge Road trunk sanitary sewer line from Point "A" to Point "D" as shown on the plat attached hereto, marked Exhibit "A". NOW, THEREFORE, the City and Developer agree as follows: 1. The Developer agrees that he'is obligated, as a condition of the Platting Ordinance, to construct an 8" vitrified clay pipe from Point "A" to Point "D" as shown on attached Exhibit "A", for purposes of providing sanitary sewer service to the London House Apartments as shown on attached Exhibit "A". 2. The Developer agrees to construct the 15" and 12" vitrified clay pipe as the Wooldridge Road trunk sewer from Point "A" to Point "D" as shown on Exhibit "A", said construction to be contracted for and financed solely by Developer. 3. The City agrees to reimburse Developer as its oversize, over - depth share of the above stated construction from Point "A" to Point "D", the sum of One Hundred Twenty-five Thousand, Five Hundred Sixty and no/100 Dollars ($125,560.00). Such reimbursement shall be made upon final acceptance of the sanitary sewer line. 4. The City agrees to exempt the Development from payment of his share of the "Wooldridge Road Trunk Sanitary Sewer Service Fee" only as authorized by the passage of separate Ordinance for the 19.394 acre tract outlined in red on attached Exhibit "A". Page 1 of 3 Exit. 5. For record purposes the City advertised for and received bids on said Wooldridge Road trunk sanitary sewer on April 21, 1982. The low bidder for the trunk sewer from Point "A" to Point "D", shown on Exhibit "A", was Chapman Construction Company. The Developer has elected to award a contract to Chapman Construction Company. Prices in this agreement are based upon bids received as result of said April 21, 1982 bid opening. 6. Developer further agrees, in compliance with City of Corpus Christi Ordinance No. 17112, to complete, as part of this Agreement, the Disclosure of Ownership Interests form attached hereto and labeled Exhibits B-1 through 8-2. 7. Developer agrees to indemnify City against any and all claims arising out of the construction of the aforesaid improvements.
