HomeMy WebLinkAbout17150 ORD - 07/28/1982AN ORDINANCE AMENDING THE.ORDINANCE GRANTING OF AN EXEMPTION FROM AD VALOREM TAXES FOR PERSONS' RESIDENCE HOMESTEAD WHO ARE 65 YEARS OF AGE OR OLDER IS IN THE BEST INTEREST OF THE CITIZENS OF THE CITY OF CORPUS CHRISTI; EXEMPTING FROM ALL AD VALOREM TAXES LEVIED EIGHTEEN THOUSAND DOLLARS ($18,000) OF THE ASSESSED TAXABLE VALUE OF SAID RESIDENCE HOMESTEAD OF SAID PERSONS UPON PROPER APPLICATION FOR SAID EXEMPTION BEING MADE AS PROVIDED BY ORDINANCE NO. 11247, AS AMENDED; PROVIDING FOR EXEMPTION FROM ALL AD VALOREM TAXES LEVIED TEN THOUSAND DOLLARS ($10,000) OF THE ASSESSED TAX- ABLE VALUE OF SAID RESIDENCE HOMESTEAD BY THOSE PERSONS QUA- LIFIED FOR THE PAYMENT OF DISABILITY INSURANCE BENEFITS AS DEFINED UNDER FEDERAL.OLD-AGE, SURVIVORS, AND DISABILITY INSURANCE OR ITS SUCCESSOR, PROVIDED PROPER APPLICATION FOR SAID EXEMPTION IS MADE WITH THE NUECES COUNTY TAX APPRAISAL DISTRICT; AND PROVIDING AN ADDITIONAL EXEMPTION OF 10 PER CENT OF ASSESSED VALUE BUT NOT LESS THAN $5,000 FOR ALL QUALIFIED RESIDENT HOMESTEADS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY: PROVIDING FOR PUBLICATION! AND DECLARING AN EMERGENCY. WHEREAS, Article 8, Section 1-b, Texas Constitution, has been amended by vote of the citizens of the State so as to authorize any city to exempt not less than Three Thousand Dollars ($3,000) of the assessed value of residence homesteads of persons sixty-five (65) years of age or older from all ad valorem taxes levied; and WHEREAS, by passage of Ordinance No. 11247, on January 10, 1973, amended by Ordinance No. 11918, on February 20, 1974, the City Council exempted from all ad . valorem taxes levied after January 1, 1973, Three Thousand Dollars ($3,000) of the assessed taxable value of residence homesteads, and by ordinance from time to time increased the amount of exemption, and particularly by Ordinance No. 15037, passed and approved on August 1, 1979, exempted from ad valorem taxes levied after January 1, 1979, Eighteen Thousand Dollars ($18,000) of the assessed taxable value of resi- dential homesteads, as that term is defined by the State Constitution and law, of persons sixty-five (65) years of age or older, provided the owner thereof or his duly authorized agent or attorney applied at the Nueces County Tax Appraisal District for the exemption on the form adopted; and WHEREAS, the City Council of the City of Corpus Christi finds hereby that providing an exemption of $18,000 of the assessed taxable value of residential homesteads is advantageous to those taxpaying citizens who are sixty-five years of age or older, and that providing an exemption of $10,000 of the assessed taxable value of residential homesteads is advantageous to those taxpaying citizens who are qualified for the payment of disability insurance benefits as defined under Federal Old -Age, Survivors, and Disability Insurance of its successors, and said exemptions will not unduly burden the other taxpaying citizens, the City's financial condition, • 17150LWL SEP 28 1984 , impair the the retirement of City bonds or impair the obligations of the contract by which any debt was created: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby exempted from all ad valorem taxes levied on or after January 1, 1980, Eighteen Thousand Dollars ($18,000) of the assessed taxable value of residence homesteads, as that term is defined by the State Constitution and law, of persons sixty-five (65) years of age or older,. provided the owner thereof or his duly authorized agent or attorney applies at the Nueces County Tax Appraisal District for said exemption. SECTION 2. That there is hereby exempted from all ad valorem taxes levied on or after January 1, 1980, Ten Thousand Dollars ($10,000) of the assessed taxable value of residence homesteads, as that term is defined by the State Consti- tution and law, by those persons qualified for the payment of disability insurance benefits as defined under Federal Old -Age, Survivors, and Disability Insurance or its successors, provided the owner thereof or his duly authorized agent or attorney applies at the Nueces County Tax Appraisal District for said exemption. Provided, however, that an eligible disabled personwhois sixty-five - (65) years of age or older may not receive both exemptions in the same year but may choose either if both methods are adopted by the taxing agency. SECTION 3. In addition to the exemptions specified in Section 1 or Section 2 above, there is hereby exempted from ad valorem taxes levied on or after January 1, 1982, ten percent of the assessed taxable value of resident homesteads, . but not less than $5,000, for all qualified homesteads as of January 1, 1982, pro- vided that the owner thereof or his duly authorized agent or attorney applies at the Nueces County Tax Appraisal District for said exemption. SECTION 4. That this ordinance shall be effective from and after August 1, 1982. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or uncon- stitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. -2- SECtION 6. Publication shall be made one time in the official ' publication.of the City of Corpus Christi, by publishing the caption of the ordinance, stating in substance the purpose of the ordinance. SECTION 7. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to adopt provisions enabling taxpaying citizens who are sixty-five years of age or older to have exempted for the payment of disability insurance benefits, as hereinabove provided, to have exempted from ad valorem taxation certain sums, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall e effect upon first reading as an emergency measure this the c:4??day of , 1982.
