HomeMy WebLinkAbout17152 ORD - 07/28/19824 • • AN ORDpANCE AMENDING ORDINANCE NO. 8127, AS AMENDED, BY AMENDING SUBSECTIONS 501, 509, 510, 551.1, 551.5, 551.6; CREATING NEW SUBSECTIONS 551.7 AND 552.5.1; AMENDING SUBSECTION 552.25; AND CREATING NEW SUBSECTIONS 707.1, 708.1, 951.3.1, 951.5, 952.4 AND 955.21; AMENDING ORDINANCE NO. 3658 BY AMENDING SUBSECTIONS 251, 252, 253, 254, 255, 256, AND 257; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8127, as amended, be and the same is hereby amended by amending Subsection 501, Public Safety Group Salary Schedule - Fire and Police, by substituting the existing Fire and Police salary schedules with the revised schedules reflecting an 81% general increase effective July 26, 1982, substantial copies being attached hereto and made a part hereof for all intents and purposes the same as if copied verbatim herein, marked Exhibits "A" and "B." SECTION 2. That Subsection 501, Salary Schedules, be amended by substituting the existing general salary schedules A and B and temporary and part-time schedules with the attached revised schedules reflecting a 7% general increase effective August 1, 1982, substantial copies being attached hereto and made a part hereof for all intents and purposes the same as if copied verbatim herein, marked Exhibits "C," HD," and "E"; and adding the new Managerial Group salary schedule setting forth minimum and maximum salary range for all positions classified within the managerial series, a substantial copy being attached hereto and made a part hereof for all intents and purposes the same as if copied verbatim herein, marked Exhibit "F." SECTION 3. That Subsection 501, Salary Schedules, be amended by deleting the last sentence in the subsection and substituting a new sentence to read as follows: "A separate salary schedule is shown for positions included in the Managerial Group, Firefighting, and Police Series of the Public Safety Group, and Temporary and Part-time positions." Said Subsection 501 to hereafter read as follows: The pay of City Employees shall be on the basis of appropriate salary schedules as prescribed herein for the respective grades of positions in the classified service as established by the Civil Service Board and for respective unclassified positions as listed herein. The general salary schedule shall consist of an entrance rate, intermediate rates, and three longevity rates. A separate salary schedule is shown for positions included in the Managerial Group, Firefighting and Police Series of the Public Safety Group, and Temporary and Part-time positions. SECTION 4. That Subsection 509, Application of the Compensation Plan to Positions in the Unclassified Service, be amended by deleting the word "grade" and substituting therefor the words "salary range." Said Subsection 509 to hereafter read as follows: Each position in the unclassified service, as established below, shall be paid according to the salary schedule for the respective salary range indicated below and at the rate within the appropriate schedule to be determined by the City Manager on the basis of his evaluation of the experience, ability, and length of service of the incumbent. SECTION 5. That Subsection 510 be amended by deleting the existing Administrative, Executive, Professional and Laborers Classification Series and substituting therefor the Managerial Classification Series, a substantial copy being attached hereto and made a part hereof for all intents and purposes the same as if copied verbatim herein, marked Exhibit "F." SECTION 6. That Subsection 551.1, Starting Rate on Initial Employment, be amended by adding to the last sentence the words and to any salary amount between the minimum and maximum annual salary range for positions in the Managerial Classifications." Said Subsection 551.1 to hereafter read as follows: On original appointment to any position classified in Salary Grades 4 through 17, the salary shall be by successive steps. The City Manager may approve initial compensation for positions in Salary Grades 4 through 17 at the B or C step in the appropriate salary grade, when the experience, skill, training or labor market conditions justify the action. The City Manager may approve initial compensation in Salary Grade 18 through 43 at the 6, C, D, E, or F step in the appropriate Salary Grade when exceptional experience, training or labor market conditions justify the action and to any salary amount between the minimum and maximum annual salary range for positions in the Managerial Classifications. SECTION 7. That Subsection 551.5, Rate of Pay on Promotion, be amended by inserting in the first sentence after "salary schedule" the words "with the exception of positions in the Managerial Group" and adding the following sentence at the end of the subsection, "Salary levels resulting from appointments to Council -appointed positions within the Managerial Group 2 r , shall be determined solely by the City Council with salary levels for all •---, other positions within the Managerial Group determined by the City Manager." Said Subsection 551.5 to hereafter read as follows: In any case where an employee is promoted to a position of class with a higher salary schedule, with the exception of positions in the Managerial Group, the entrance salary rate shall be at the lowest step in the higher salary schedule that will provide a minimum 4% increase over the salary received immediately prior to such promotion. Subsequent advancement to higher steps in grade will be on the same basis as described in paragraph 552. Salary levels resulting from appointments to Council -appointed positions within the Managerial Group shall be determined solely by the City Council with salary levels for all other positions within the Managerial Group determined by the City Manager. SECTION 8. That Subsection 551.6, Rate of Pay on Classification Series Changes, be amended by inserting in the first sentence after "classification changes" the words "with the exception of changes within the Managerial Group." Said Subsection 551.6 to hereafter read as follows: Employees advanced to a higher salary grade as a result of classification changes, with the exception of changes within the Managerial Group, shall be advanced to the lowest step in the higher salary grade which will provide a minimum 51 salary increase over the salary received immediately prior to the classification change. Employees who would have otherwise been entitled to receive a step increase as a result of longevity had the reclassification not occurred shall only be eligible to receive the next step increase within the new salary grade if this longevity step falls due less than six months after the effective date of the reclassification. Employees who would have otherwise been entitled to receive a step increase as a result of longevity had the reclassification not occurred which falls due six months or longer from the effective date of reclassification, will be eligible to advance after conforming with the required time in service at that step. All subsequent step advancements shall be granted in conformity with the required time in service provided for each step within the general salary schedule. SECTION 9. That a new Subsection to be numbered 551.7 and entitled, Classification/Title Changes Within the Managerial Group, be added to read as follows: 551.7 Classification/Title Changes Within the Managerial Group. At the beginning of each fiscal year, the City Council, upon recommendation of the City Manager, shall set minimum and maximum salary ranges for each position assigned to the Managerial Group. Throughout the fiscal year, employee salary levels, . appointments, reclassifications, and title changes within the Managerial Group, with the exception of Council -appointed positions, shall be individually determined at the discretion of the City Manager provided such changes are 3 made within the Council -approved appropriation of total salaries funded for the fiscal year. SECTION 10. That a new Subsection to be numbered 552.5.1 be added to read as follows: 552.5.1 Salary advancement within the Managerial Group, with the exception of Council -appointed positions, shall be made at the sole discretion of the City Manager and shall be based upon an annual review of job performance. More frequent evaluations of job performance may be conducted by the City Manager as deemed necessary." SECTION 11. That Subsection 552.25 be amended by adding to the last sentence the words "and employees within the Managerial Group." Said Subsection 552.25 to hereafter read as follows: 552.25 If solely in the considered judgment of the Department Head, an employee's overall job performance for a six-month period is not fully satisfactory, the Department Head may, upon approval of the City Manager, withhold a salary increase or reduce the employee's salary by one step. The reason for such salary reduction shall be stated on or accompany the payroll form authorizing such reduction. Further reductions in step may be made where the less than satisfactory performance continues, but no more than one reduction may be made in any six-month period. After any such reduction the employee's length of service in the reduced step shall be deemed to commence on the date of the reduction. At any time, the Department Head may, upon his determination that the employee's performance has been consistently satisfactory, advance the employee to a higher step not to exceed the step and seniority in step held by the employee at the time of his reduction. Provided, nothing contained in this Section 552.25 shall prevent the Department Head from using other measures, including but not limited to reprimand, counseling, suspension or termination, to eliminate performance that is not fully satisfactory. This provision applies to all employees except Firefighters and Police Officers covered by collective bargraining agreement and employees within the Managerial Group. SECTION 12. That a new Subsection to be numbered 707.1 be added to read as follows: 707.1 The City shall pay 100% of the cost of $50,000 term life insurance for all employees classified within the Managerial Group with the exception of Police and Fire classifications below the rank of Chief. An additional $50,000 term life insurance shall be made available to these employees on an optional basis at personal expense. SECTION 13. That a new Subsection to be numbered 708.1 and entitled, Lump Sum Productivity/Merit Payment, be added to read as follows: 708.1 Lump Sum Productivity/Merit Payment The City Manager may authorize a non -cumulative lump sum payment to any employee in recognition of improved productivity or meritorious service. Such payment shall not exceed an amount equal to 10% of the employee's annual salary. 4 SECTION 14. That a new Subsection to be numbered 951.3.1 be added to read as follows: 951.3.1 Effective August 1, 1982, all employees eligible to accrue vacation leave, with the exception of Fire and Police covered by collective bargaining, shall be granted one additional day of vacation. Thereafter, beginning on July 26, 1982, these same employees shall begin to accrue one additional day of vacation above their normal vacation accrual as provided in Sections 951.1, 951.2, and 951.3. New employees hired after July 26, 1982, who are eligible to accrue vacation shall accrue vacation leave in the same ratio as 11 working days bears to 40 hours. SECTION 15. That a new subsection to be numbered 951.9 be added to read as follows: 951.9 When recruiting for any position within the managerial group, the City Manager shall have authority to grant advanced vacation and sick leave days and establish the rate of accrual for vacation and sick leave. SECTION 16. That a new Subsection to be numbered 952.4 be added to read as follows: 952.4 With the exception of Fire and Police covered by collective bargaining, employees who have accrued 90 days or more sick leave shall be eligible to annually "cash in", at their regular salary rate, 50% of all unused sick leave days accrued during the prior year over 8 days. SECTION 17. That a new Subsection to be numbered 955.21 be added to read as follows: 955.21 The City Manager may authorized lump sum payments for involuntary termination within the managerial group in amounts not to exceed the equivalent of six (6) monthssalary. SECTION 18. That Ordinance No. 3658, as amended, be amended by deleting the present Subsections 251, 252, 253, 254, 255, 256, and 257 and substituting therefore new Subsections 251, 252, 253, 254, 255, 256, and 257, substantial copies being attached hereto and made a part hereof for all intents and purposes the same as if copied verbatim herein, marked Exhibits "G," "H," "I," "J," "K," "L," and "M." SECTION 19. Except as otherwise may be provided herein, the effective dates of the above changes shall be August 1, 1982. SECTION 20. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of,this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this 5 City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 21. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for maintaining efficient administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 24 day of July, 1982.
