AMENDING THE CODE OF ORDINANCE, CITY OF CORPUS
CHRISTI, TEXAS, VOLUME II, CHAPTER 55 UTILITIES,
ARTICLE IV, CAS RATES AND CHARGES, SECTION 55-61
CLASSIFICATION OF CUSTOMERS AND SCHEDULES OF RATES,
AS SET FORTH IN ORDINANCE NO. 16451, AS AMENDED,
SO AS TO CHANGE THE SCHEDULE OF GAS RATES FOR ALL
CUSTOMERS TO THE CITY -OWNED GAS DISTRIBUTION SYSTEM
BY PROVIDING A NEW SCHEDULE OF RATES FOR ALL GAS
CUSTOMERS; PROVIDING FOR RATE ADJUSTMENT TO PASS
ON TO THE CONSUMER THE FULL AMOUNT OF SUCH COST OF
GAS; PROVIDING AN EFFECTIVE DATE; PROVIDING A
,SEVERANCE CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the cost of providing natural gas for the customers of
the Corpus Christi Gas System has increased as a result of increased prices
of natural gas charged by suppliers; and
WHEREAS, the price of natural gas charged by suppliers is expected
to continue to increase monthly; and
WHEREAS, the cost of operating and maintaining the City's gas
distribution system has increased due to inflation since the last service
rate increase in September, 1981; and
WHEREAS, the City Council finds that an increase in gas rates
is necessary to keep such service self-supporting.
, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 55-61 of the CODE OF ORDINANCES, 1976,
as amended, and particularly as amended by ORDINANCE NO. 16451 passed, approved,
and effective with reading and billing of cycle 1 of the August, 1981, billing,
be and the same is hereby amended so as to provide a new schedule of rates for
all customers.

SEASONAL CUSTOMERS
All customers who have requested a cutoff and reconnection at the same
location or for services to the same premises, including increases or
reductions of the same premises, and which cutoff was not necessitated
by reason of reconstruction of the building on the premises, shalltv

as seasonal customers, and in lieu of the rates applicable to all customers,
there shall be charged and collected the following charges for gas furnished
and delivered to the meters by the Department of Public Utilities of the City:

INCENTIVE AIR COOLING & CONDITIONING RATE
(Limited to customers using less than 15 million
cubic feet per month annual average)
All general rate customers that have installed total energy or have gas
operated air-cooling and air conditioning equipment or both and have an
average volume used in MCF per month in the seven summer months that exceed
the five winter months average use, when inspected and approved by the Gas
Division, who request in writing to be billed in the summer months on the
Summer Incentive Gas Rate Schedule starting with Cycle 11 in April and ending
with the billing of Cycle 10 in November shall be billed on the following
rate schedule:

SECTION 2. PURCHASED GAS ADJUSTMENT. These rates are subject
to gas cost adjustments as follows: Rates will be adjusted monthly by the
City following the receipt of notice of cost of gas from the supplier to pass
on to the consumer the full amount of such cost adjusted for pressure base ,
and gas lost and unaccounted for factors. All general customers who consume
over 15,000 MCF in one month and who receive gas from the City's distribution
system at the same pressure which the City receives the gas from its supplier
(14.65 psi) shall be billed 2.05% less per MCF for purchased gas adjustment
than the general customer rate schedule.
SECTION 3. The rates established by this ordinance'shall be
applied against all gas consumed beginning with Cycle 1 on or around
August 1, 1982, and which shall be billed to customers beginning with
Cycle 1 on or around September 1, 1982.
SECTION 4. INTERRUPTIONS: Deliveries of gas to commercial
or industrial customers may be interrupted or curtailed in case of
shortage or threatened shortage of gas supply from any cause whatsoever,
to conserve gas for residential and other human need customers served
hereunder, according to all mandatory orders of governmental agencies ,
having jurisdiction.
SECTION 5. That all ordinances or parts of ordinances in con—
flict herewith be the same and are hereby repealed to the extend of such
conflict.
SECTION 6. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word,'
or provision hereof be given full force and effect for its purpose.
SECTION 7. Publication shall be made one time in the official
publication of the City of Corpus Christi, which publication shall contain
the caption stating in substance the purpose of the ordinance.
