AMENDING SECTION 19-61 OF THE CODE OF ORDINANCES
TO PROVIDE A REVISED SCHEDULE OF FEES FOR FOOD
SERVICE PERMITS; TO PROVIDE FOR REDUCED FEES ON
A PRORATED BASIS FOR PERMITS ISSUED IN CERTAIN
MONTHS OF THE YEAR; PROVIDING FOR SEVERANCE;
AND PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That Section 19-61 of the Code of Ordinances,
City of Corpus Christi, 1976, as amended, be amended by amending
paragraph (b) thereof to hereafter read as follows:
"(b) Prior to the issuance of a food service permit, the
applicant shall pay a fee according to the following schedule:
Food Service or Food Processing Establishments
Having more than 18 employees
9 through 18 employees $172:
4 through 8 employees 100
Fewer than 4 employees 50
Temporary food service establishments 25
Retail Food Store 50
(1) No fee will be charged for a food service operation
conducted by a taxing authority, such as a school district, whether
local, state or federal.
(2) For permanent establishments, the fee shall be reduced
by 25% if the permit is issued in April, May, or June: by 50% if the
permit is issued in July, August, or September; and 75% if the permit
is issued in October, November, or December."
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word,
or provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made in the official publication
of the City of Corpus Christi one time, which publication shall contain the
caption stating in substance the purpose of the ordinance.
