HomeMy WebLinkAbout17170 ORD - 08/04/1982AN ORDINANCE AUTHORIZING A CONTRACT WITH CALLINS, HAGGARD AND ASSOCIATES, INC., FOR ENERGY REDUCTION STUDIES IN THE CONVENTION CENTER AREA; APPROPRIATING $4,000 FOR THE PROJECT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a contract with Callins, Haggard and Associates, Inc., for energy reduction studies in the Convention Center area, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated out of the No. 209 Community Convention Facility Bond Fund the sum of $4,000 for Phase I of the aforesaid contract, applicable to Project No, 209-76-7, Auditorium Improvements. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs by authorizing the aforesaid contract, such finding of an emergency is made and declared requir- ing suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the lilday of August, 1982. Services to be Performed: The Engineer hereby agrees, at his own expense, to perform all architectural, structural, mechanical, electrical, site work design, and related studies, estimates and services necessary to properly develop design plans and specifications for Corpus Christi Convention Center Area Facilities Improvements as outlined in the Scope of Services contained herein. 11. Scope of Services: The Engineer agrees to perform, for the above named work, professional services as hereinafter set forth: A. Study Phase - Phase I 1. Study, review and recommend the feasibility of a looped electrical system being provided in the area of the Convention Center for the purpose of Improved service reliability and also to determine if/what cost savings would result in a single electrical meter concept of service to the Convention Center, the Art Museum of South Texas, the Corpus Christi Museum, the Harbor Playhouse and the Historical Homes. 2. Determine feasibility of providing chilled water to the Art Museum of South Texas from the Convention Center, what costs would be involved, and what, if any, energy savings would result. Also advise the City on estimated cost and any associated problems which would result in the installation of a third or backup chiller for the Convention Center air-conditioning system. 3. Study, review and recommend methods of providing additional heating to the Community Auditorium, particularly in the area of the orchestra section, and methods of adding additional insulation to the Auditorium. Provide estimated costs for all work as well as any savings which might be realized in the heating system as a result of such insulation. B. Construction Documents Phase - Phase II Engineer acknowledges that no work in Phase II is authorized unless (a) such authorization is in writing from the City and (b) funds are appropriated for engineering work in Phase II. EXHI IT "A" 1. Prepare complete working drawings and technical specifications setting forth in detail the requirements for furnishing and installing the facilities outlined in Article 11 when so authorized in writing. The Engineer will confer with the City staff during this phase to coordinate the design of the project and incorporate all desired features. Review the cost estimate and advise the City of any changes. 3. Submit to the City Engineer three complete sets of the Documents as outlined in Section B-1 for review by the City. C. Bidding and contract Phase 1. Upon approval of the Construction Documents by the City, provide the City with reproducible copies of the documents required in Section B. 2. Provide a list of prospective qualified bidders in the area to the City. 3. Submit a written recommendation of the award of the contract to the City. In the event the lowest acceptable bid exceeds the estimated cost, the Engineer shall confer with the City and make such revisions as is satisfactory to the City for the readvertising of bids, without increases in the basic fee. D. construction Phase 1. Be the City's representative during the construction period which begins with the award of the contraCt and extends until the final acceptance of the -project. 2. Provide the general administration of construction including periodic visits to the site to familiarize himself generally with the progress and quality of the work and to determine in general if the wurk is proceeding in accordance with the contract. The Engineer will endeavor to guard the City against defects and deficiencies in the work of contractors, but he does not guarantee the per- formance of their contract. 3. Have the authority to stop work whenever such stoppage may be necessary in his reasonable opinion to insure the proper execution of the contract and may condemn work as failing to conform to the contract. 4. Not be required to make exhaustive or continuous on-site inspections normally defined as resident inspection, but will make those inspections necessary to certify that, to the best of his knowledge, work has progressed to the point indicated, the quality of the work is in accordance with the construction contract, and the contractor is entitled to payment. Professional Services Contract Callins & Haggard Page No. 2 E. As -Built Drawings and Maintenance Manuals 1. The Engineer shall furnish to the city, upon completion of said project, or upon termination of this contract as herein provided, a suitable bound copy of the specifications and a reproducible set on mylar, or tracing of the working drawings including any and all corrections, revisions, alterations, or amendments to the plans and/or specifications made during the Construction Phase so as to reflect the true plans and specifications of the building as built. 2. The Engineer shall use 24" x 36" sheet sizes of 3 mil mylar or tracing for the "as -built" drawings which are to be submitted as described above. 3. The Engineer shall furnish to the City upon project completion, operating manuals or instructions, parts lists, or maintenance manuals for all mechanical, electrical, or any other equipment installed on the project. 4. The City will not make final payment to the Engineer until the conditions of Section E are met. F. Transfer of Interest The Engineer shall not assign or transfer any interest in this contract without prior written consent from the City. G. Orderly Rendering of Services The Engineer shall furnish the documents required in each phase of the design and personally render or provide the service required in this contract in the Sequence and times herein indicated and as may be necessary to insure the prompt and continuous prosecution of the work of designing and constructing the project, and it is understood that all designs and details of designing are subject to the approval of the City, and until the acceptance of results of these services, there shall be no liability on the part of the City for such services. The Engineer agrees to furnish items required of Phase I (Study Phase) to the City within forty-five (45) calendar days of approval of date of Contract. The Engineer further agrees to provide Phase II (Construction Documents) within sixty (60) calendar days of written authorization to begin work in this phase. H. Cost Estimates The Engineer is to provide an estimate of costs at the time of the Phase 1 or Study Phase submittal as well as with the submission of the Construction Documents Phase, but does not guarantee the accuracy of such estimates; however, the Engineer shall endeavor to design the project so that the cost thereof does not exceed the amount allocated for construction. The City will have the right Professional Services Contract Callins & Haggard Page No. 3 to require the Engineer to make revisions to the Construction Documents so as to being the cost within funds available at no additional fee. III. Compensation: A. Fee Schedule The City agrees to pay the Engineer for his services in designing and related work a lump sum not to exceed Four Thousand Dollars ($4,000.00) for the Phase I or Study Phase. Billing for this phase by the Engineer will be based on the hourly rate times 2.5 of the Engineer's staff working on the project, and will be paid by the City upon acceptance of Phase I work. Payment for Phase II will be determined at a later date by amendment to this contract when the scope of work for Phase 11 has been determined after the Phase I study is completed, at which time further definition of the Phase II scope of work may be set forth and funds for additional engineering work appropriated as required. Engineer agrees that a portion of the fees paid for Phase I work will be credited against Phase II fees; said credit portion to be determined when the Phase II scope is further established. E. Payment to the Architect 1. Upon completion of the Construction Documents Phase in Phase II and acceptance and approval of same by the city, a sum equal to seventy-five percent (75%) of the Basic Fee as later determined for Phase II shall be paid to the Engineer. 2. upon receipt of bids and award of a construction contract, a sum equal to five percent (5%) of the Basic Fee provided for Phase II shall be paid to the Engineer. 3. Upon completion of the Construction Phase, a sum equal to twenty percent (20%) of the Basic Fee provided for Phase II shall be paid to the Engineer. Final payment will -not be made to the Engineer until the condition of Article II, Section E is met. 4. In regard to the Engineer's Fee, the parties further agree: No deductions shall be made from the Engineer's Fee on account of penalty, liquidated damages, or other sum withheld from payments to the contractor but the City will not pay the Engineer a fee for change orders necessitated as a result of negligence or omissions on the part of the Engineer. Iv. The City reserves the right to terminate this contract at any time with or without cause. In the event of such termination, the Engineer will be paid a sum proportionate to the state of completion of the phase of work in which he is then engaged.
