HomeMy WebLinkAbout17180 ORD - 08/04/1982skp;7/20/82;1st .- AN ORDINANCE AMENDING SECTION 6-32 OF THE CODE OF ORDINANCES TO PROVIDE ADDITIONAL REGULATIONS FOR THE RENEWAL OR CONTINUATION OF AN EXISTING PERMIT FOR A PROHIBITED ANIMAL. , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 6-32 of the Code of Ordinances, City of Corpus Christi, 1976, as amended, is hereby amended by amending paragraph (d) thereof to hereafter read as follows: "(d) Any prohibited animal, except those which, on the date of publication following the third and final reading of Ordinance No. 16135 from which this chapter derives, are present within the City and are owned by a.person who makes application to the City health officer for a prohibited animal permit on or before April 30, 1981, and who has been granted a pro- hibited animal permit pursuant to regulations promulgated by the City health officer and on file with the City Secretary; provided, however, that such permit shall not be required for a bona fide zoological park; (1) Any applicant for a permit or renewal of permit whose animal is subject of hearing, will be required to notify by certified mail, all property owners within 500 feet of the applicant's property lines; of the intent to keep, or continue to keep the animal on his property to ensure that there is an opportunity to object to issuance of a permit. If more than 50 percent of the neighbors file individual objections to the keeping of this animal with the Director of Health, the Director shall deny the permit. Such denial by the Director may be appealed by the applicant to the City Council as provided in the regulations. (2) Any applicant for such permit or renewal must also provide public liability insurance naming the City of Corpus Christi as additional insured in the amount of at least $250,000 for personal injury and $50,000 for property damage. Such policy must contain the statement that the insurance company shall give the City at least 10 days advance written notice prior to cancellation of such insurance coverage. SECTION 2. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be held invalid or un- constitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
