CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A
CHARTER AMENDMENT ELECTION HELD IN THE CITY OF CORPUS
CHRISTION THE 14TH DAY OF AUGUST, 1982, UPON THE
QUESTION OF BINDING ARBITRATION FOR COLLECTIVE BARGAINING
IMPASSES FOR FIRE AND POLICE, PROVIDING FOR SEVERABILITY;
AND DECLARING AN EMERGENCY.
WHEREAS, heretofore on July 14, 1982, the City Council of the City
of Corpus Christi passed Ordinance No. 17124 calling an election on the
question of adopting an amendment to the City Charter of the City of Corpus
Christi, said election to be held in said City of Corpus Christi on the 14th
day of August, 1982, which proposition set out therein, is incorporated
herein by reference; and
WHEREAS, it appears that all requirements of the law respecting the
submission of amendments of a City Charter to the qualified voters were in
all respects lawfully and properly performed and executed; and
WHEREAS, notice of said election was accordingly given as required
by law, and as directed by the City Council, as is shown by affidavits
properly filed in the office of the City Secretary; and
WHEREAS, said election was duly and legally held on the 14th day of
August, 1982, in conformity with the election ordinances heretofore passed by
this City Council, and the result of said election has been duly certified
and returned to this Council by the special canvassing board, proper judges
and clerks of said election; and
WHEREAS, this Council has canvassed the returns of said election on
the proposition voted upon at the election which was held on the 14th day of
August, 1982; and
WHEREAS, it appears to the Council, and the Council so finds, that
said election was in all respects lawfully held and said returns duly and
legally made, and that there were cast at said election the following votes:
Shall the City Charter be amended to add a provision
amending existing Fire and Police collective bargaining
agreements to require, upon request of either party, that
the City and the employee associations be compelled to Yes 5,476 a --

other terms and conditions of employment on which the
City cannot agree with the exclusive bargaining agent for
City firefighters and all such issues on which the City
cannot agree with the exclusive bargaining agent for City
police officers?
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the proposition set forth in Ordinance No. 17124
calling said election on the question of adopting amendment to the City
Charter of the City of Corpus Christi, which Proposition is incorporated
herein by reference is hereby found to have been defeated by a majority of
the qualified voters of the City voting at said election on August 14, 1982;
in accordance with the said tabulation of votes hereinabove set forth, the
City Council finds that the Proposition was defeated by a majority of the
votes.
The tabulation of votes cast at the election on said Proposition is,
hereby adopted and said proposition is declared defeated by a majority of the
votes.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
the prompt canvassing the result of said election for binding arbitration for
collective bargaining impasses for fire and police, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this resolution is passed and shall take effect upon first
reading as an emergency measure this the 1B

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; 1/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
