HomeMy WebLinkAbout17215 ORD - 08/18/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF NUECES INVESTMENT COMPANY BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF FARRELL J. SMITH 225.20 ACRF TRACT FROM "R-16" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Nueces Investment Company for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held �n Wednecday. August 18, 1982 , at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the CifY of Corpus"' Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tract or parcel of land being described as a portion out of Farrell J. Smith 225.20 acre tract situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R-16" One -family Dwelling District to "R-2" Multiple Dwelling District: sgp 2 8 1984 MICROFILMa 17215 Description of 5.657 acres of land, more or less, out of the Farrell J. Smith 225.20 acre tract of land out of the Mariano Lopez de Herrera grant, Abstract No. 606, Nueces County, Texas and further described by metes and bounds as follows: BEGINNING at a 5/8" iron rod found at the southwest corner of Lot 10, Cenizo Canyon, as shown by plat recorded in Volume 37, Pages 173 and 174 of the Map Records of Nueces County, Texas, said beginning 5/8" iron rod for an easterly corner of this tract; THENCE S43°09'53"W 15.03 feet to a 5/8" iron rod set in a circular curve to the right having an initial tangent bearing of N43'28'55"W, a central angle of 38°28'55", a radius of 29.06 feet and a tangent length of 10.14 feet; THENCE along the arc of said circular curve to the right, a distance of 19.52 feet to a 5/8" iron rod set at the point of curvature of a circular curve to the left, having a central angle of 140°34'15", a radius of 40.00 feet and a tangent length of 111.63 feet; THENCE along the arc of said circular curve to the left, a distance of 98.14 feet to a 5/8" ion rod set at the point of curvature of a circular curve to the right whose central angle is 29°19'15", whose radius is 38.06 feet and whose tangent length is 9.96 feet; THENCE along said circular curve to the right, a distance of 19.48 feet to a 5/8" iron rod set at the point of tangency; THENCE S63°45'00"W 84.06 feet to a 5/8" iron rod set at the point of curvature of a circular curve to the left having a central angle of 38°45'00", a radius of 408.30 feet and a tangent length of 143.59 feet; THENCE along the arc of said circular curve to the left, a distance of 276.14 feet to a 5/8" iron rod set at the point of tangency; THENCE 525°00'00"W southerly corner of THENCE N65"00.00"W southerly corner of THENCE S67°45'00W southernmost corner 170.00 feet to a 5/8" iron rod set for a this tract; 53.14 feet to a 5/8" iron rod set for a this tract; 196.47 feet to a 5/8" iron rod set for the of this tract; THENCE N36°30'00"W 25.79 feet to a 5/8" iron rod set for a southerly corner of this tract; THENCE N58°35'52"W 147.00 feet to a 5/8" iron rod set for the southwest corner of this tract; THENCE N09°51'00E along said westerly boundary line of 225.20 acre Farrell J. Smith tract at 334.93 feet pass a 5/8" iron rod set for reference point, in all a distance of 354.93 feet to an unmarked corner in the southerly shoreline of the Nueces River; THENCE along the following unmonumented meanders of said shoreline of Nueces River; N88°42'15"E 147.65 feet N79°01'25"E 142.97 feet N68°54'40"E 256.99 feet N65'08'30E 179.67 feet N55°2450"E 75.52 feet to a point for the northernmost corner of this tract, said point being a northwesterly corner of said Lot 10, Cenizo Canyon; THENCE 500°08'00"N ':along the westerly boundary line of said Lot 10, Cenizo Canyon at 20.00 feet pass a 5/8" iron rod set for reference point, in all a distance of 264.65 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of ATTEST: Ci y Secretary APPROVD:- //-1X-DAY OF J.
