AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.40 SETTING FORTH ZONING CLASSIFICATION
ON SAID AREA OF LAND DESCRIBED AS A PORTION OF LOTS 3
THRU 8, SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND
GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Barjon, Inc.,
and Mark P. Bratton for amendment to the zoning map of the City of Corpus
Christi;
WHEREAS, public hearing was held at' which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, August 25,
1982, at Regular Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:,
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "R -1C"
One -family Dwelling District on a portion of Lots 3 thru 8, Section 6, Flour
Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, more fully
described hereinafter, be granted;
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels of
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.40, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.40. The following described tract of land shall be
zoned and classified as follows:
"R -1C" One -family Dwelling District on the following more
particularly described
FIELDNOTES for proposed "R -1C" zoning of 90.12 acres of
land out of Lots 3, 4, 5, 6, 7, and 8, Section 6, Flour
Bluff and Encinal Farm and Garden Tracts, a map of which
is recorded in Volume A, Pages 41, 42, and 43, Map
Records of Nueces County, Texas:
BEGINNING at the point of intersection of the centerline
of South Staples Street, with the centerline of a 40.00
foot wide county road, for the East corner of said Lot 8,
Section 6 and the East corner of this tract;
THENCE South 28°56'00" West, with said centerline of
South Staples Street, same being the Southeast boundary
of said Lot 8, Section 6, 990.00 feet for the South
corner of this tract;
THENCE North 61°02'00" West, leaving said centerline of
South Staples Street, 3,965.39 feet to a point on the
Northwest boundary of said Lot 3, Section 6 for the West
corner of this tract;
THENCE North 28°56'00" East, with said Northwest boundary
of said Lot 3, Section 6, 990.00 feet to a point on the
aforementioned centerline of said 40.00 foot wide county
road for the North corner of this tract;
THENCE South 61°0200" East, with said centerline of said
40.00 foot wide county road, same being the Northeast
boundary of said Lots 3-8, 3,965.39 feet for the Point of
Beginning, save and except the following tracts proposed
for R -1B zoning:
TRACT I
BEING 4.32 acres of land, more or less, out of Lot 8,
Section 6 of said Flour Bluff and Encinal Farm and Garden
Tracts:
BEGINNING at a point on the centerline of a 40.00 foot
wide county road, same being the Northeast boundary of
said Lot 8, for the East corner of this tract from which
corner the centerline intersection of said 40.00 foot
wide county road and South Staples Street for the East
corner of said Lot 8, Section 6 and the East corner of
said 90.12 acre tract bears South 61002100" East 315.00
feet, more or less;
THENCE South 2805800" West, leaving the centerline of
said 40.00 foot wide county road, 800.50 feet, more or
less, for the South corner of this tract;
THENCE North 61°02'00" West 235.00 feet, more or less,
for the West corner of this tract;
THENCE North 2805800" East 800.50 feet, more or less, to
a point on the aforementioned centerline of said 40.00
foot wide county road for the North corner of this tract;
THENCE South 6100200" East, along said centerline,
235.00 feet, more or less, for the Point of Beginning.

BEING 5.25 acres of land, more or less, out of Lot 7,
Section 6 of said Flour Bluff and Encinal Farm and Garden
Tracts:
BEGINNING at a point on the centerline of a 40.00 foot
wide county road, same being the Northeast boundary of
said Lot 7, for the East corner of this tract from which
corner the centerline intersection of said 40.00 foot
wide county road and South Staples Street for the East
corner of Lot 8, Section 6 of said Flour Bluff and
Encinal Farm and Garden Tracts and the East corner of
said 90.12 acre tract bears South 61002100" East 815.00
feet, more or less;

said 40.00 foot wide county road, 990.00 feet, more or
less, for the South corner of this tract;

for an angle point of this tract;

SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the
