HomeMy WebLinkAbout17230 ORD - 09/01/1982AN ORDINANCE AUTHORIZING THE ACQUISITION OF A 15', DRAINAGE AND UTILITY EASEMENT TOGETHER WITH A 30' TEMPORARY CONSTRUCTION EASEMENT IN CONNECTION WITH THE BROOKHAVEN-FIVE POINTS • AREA SANITARY SEWER IMPROVEMENTS; APPROPRIATING $1,000 FOR THE ACQUISITION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute the necessary documents for the acquisition of a 15' drainage and utility easement together with a 30temporary construction easement in connection with the Brookhaven -Five Points Area Sanitary Sewer Improvements, a substantial copy of which documents are attached hereto and made a part' hereof marked Exhibit "A." SECTION 2: That there is hereby appropriated $1,000 out of the No. 250 Sanitary Sewer Bond Fund applicable to Project No. 250-77-12 for the acquisition.' SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find,anddeclare an emergency due to the need to take immediate action to preserve and protect pUblic property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that. this ordinance is passed and shall take effect upon first reading as an emergency measure this the/,al day,of September, 1982. Together with a 30' temporary construction easement west of and adjacent to abovementioned permanent drainage and utility easement to be used for working room and storage of materials during construction phase. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas, for the purpose of construct- ing, laying and keeping public utility lines, and for the pur- poses of maintaining, servicing, repairing and inspecting said lines under, on and along said tract; and for drainage pur- poses. TO HAVE AND TO HOLD, all and singular, the rights and privi- leges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives, for the proper use as a utility easement and utility right-of-way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that event, the afore- said rights and privileges shall cease.
