AUTHORIZING THE ACQUISITION OF A 15', DRAINAGE AND UTILITY
EASEMENT TOGETHER WITH A 30' TEMPORARY CONSTRUCTION
EASEMENT IN CONNECTION WITH THE BROOKHAVEN-FIVE POINTS •
AREA SANITARY SEWER IMPROVEMENTS; APPROPRIATING $1,000
FOR THE ACQUISITION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized to
execute the necessary documents for the acquisition of a 15' drainage and
utility easement together with a 30temporary construction easement in
connection with the Brookhaven -Five Points Area Sanitary Sewer Improvements,
a substantial copy of which documents are attached hereto and made a part'
hereof marked Exhibit "A."
SECTION 2: That there is hereby appropriated $1,000 out of the No.
250 Sanitary Sewer Bond Fund applicable to Project No. 250-77-12 for the
acquisition.'
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find,anddeclare an emergency due to the need to
take immediate action to preserve and protect pUblic property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that. this
ordinance is passed and shall take effect upon first reading as an emergency
measure this the/,al day,of September, 1982.

KNOW ALL MEN BY THESE PRESENTS:

of the County of Nueces, State of Texas, for and in considera-
tion of the sum of One Thousand Dollars and no cents
( $1,000.00 )
to it in hand paid by the City of Corpus Christi, Nueces
County, Texas, the receipt of which is hereby acknowledged,
have granted and conveyed, and by these presents do grant
and convey unto the City of Corpus Christi, Texas, a municipal
corporation duly incorporated under and by virtue of the laws
of the State of Texas, its successors and legal representatives
the free and uninterrupted use, liberty, privilege, and ease-
ment of going in, on, over, under, and along a certain tract
of land situated in Nueces County, Texas and being described
as follows:
Being a 15 foot wide strip of land out of the Gregorio Farias
portion of the Barranco Blanco Grant Abstract No. 592, Nueces
County, Texas, more particularly described as follows:
Beginning at the southeast corner of Lot 7, Block 3 of Country
Estates Unit No. 2 Subdivision, Volume 22, Page 43, county Map
Records, and point of beginning of this easement;
Thence S. 2° 30' E., 460.72 feet along the west boundary of
Block 1.of Country Estates Unit No. 38 Subdivision, Volume
33, age 89, County Map Records;
Thence S. 10° 32' 10" E., 199.79 feet along said west boundary
of Block 1 to the southwest corner of Lot 15, Block 1 and
point being the southeast corner of this easement;
Thence S. 790 27' 50" W., 15 feet to the southwest corner of
this easement;
Thence N. 100 32' 10" W., 200.84 feet;
Thence N. 2° 30' W., 459.92 feet to the northwest corner of
this easement;
Thence N. 800 26' 10" E., 15.12 -feet along the south boundary
of said Lot 7, Block 1 to the northeast corner and Point of
Beginning of this easement and containing approximately .227
acres of land.
Together with a 30' temporary construction easement west of
and adjacent to abovementioned permanent drainage and utility
easement to be used for working room and storage of materials
during construction phase. Said temporary easement to be a-
bandoned upon completion of project.

A map of which is marked "Exhibit A" and attached hereto and
made a part hereof for all purposes.
Together with the free ingress, egress, and regress to and for
the City of Corpus Christi, Texas, for the purpose of construct-
ing, laying and keeping public utility lines, and for the pur-
poses of maintaining, servicing, repairing and inspecting said
lines under, on and along said tract; and for drainage pur-
poses.
TO HAVE AND TO HOLD, all and singular, the rights and privi-
leges aforesaid to the City of Corpus Christi, Texas, its
successors and legal representatives, for the proper use as
a utility easement and utility right-of-way, for so long as
used for such purpose, and if the use for said easement and way
of said uses be ever abandoned, then in that event, the afore-
said rights and privileges shall cease.
