CLOSING AND ABANDONING THE 10 FOOT WIDE UTILITY EASEMENT
IN LOTS 11 AND 12, BLOCK 1, BEHMANN SUBDIVISION; AND
DECLARING AN EMERGENCY.
WHEREAS, a 10 foot wide utility easement exists which is adjacent
to Lots 11 and 12, Block 1, Behmann Subdivision, shown by map recorded in
Volume 47, Pages 51 and 52, Map Records, Nueces County, Texas, and as more
particularly described by metes and bounds as follows:
FIELDNOTES for the abandonment of a 10.00 foot wide
utility easement out of Lots 11 and 12, Block 1, Behmann
Subdivision, a map of which is recorded in Volume 47,
Pages 51 and 52, Map Records of Nueces County, Texas:
BEGINNING at a point on the Northeast boundary of an
existing 5.00 foot wide utility easement for the West
corner of this easement from which corner the West corner
of said Lot 11, Block 1, bears South 28° 22 00" West
5.24 feet to a point of the Southwest boundary of said
Lot 11, thence North 61° 40' 00" West 163.05 feet;
THENCE North 28° 22' 00" East 694.76 feet for the North
corner of this easement;
THENCE, South 61° 40' 00" East 10.10 feet for the East
corner of this easement;
THENCE, South 28° 22' 00" West 694.76 feet to a point on
the aforementioned Northeast boundary of said 5.00 foot
wide utility easement for the South corner of this
easement;
THENCE, North 61° 40' 00" West, with said Northeast
boundary of said 5.00 wide utility easement, parallel to
the aforementioned Southwest boundary of said Lot 11,
thereof and 5.00 feet distant therefrom, measured at
right angles thereto, 10.10 feet for the POINT OF
BEGINNING.
WHEREAS it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 foot wide utility easement in Lots 11 and
12, Block 1, Behmann Subdivision, shown by map recorded in Volume 47, Pages
51 and 52, Map Records, Nueces County, Texas, be closed and abandoned.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid utility easement, such finding of an emergency is made and declared

requiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; 1/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
