HomeMy WebLinkAbout17249 ORD - 09/08/1982er A AN ORDINANCE AMENDING THE PLATTING ORDINANCE BY DELETING THE PRESENT SUBSECTIONS A.11 AND A.12 OF SECTION IV AND SUBSTITUTING A NEW SUBSECTION A.11 PROVIDING FOR MAXIMUM SUBDIVIDER RIGHT-OF-WAY DEDICATIONS OF 100 FEET AND MAXIMUM STREET PAVING OBLIGATIONS OF SUBDIVIDER BEING 48 FEET; DELETING SUBSECTION A - OFFSITE IMPROVEMENTS OF SECTION VI - EXCEPTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi Platting Ordinance No. 4168, as amended, be amended by deleting the present Subsection A.31 of Section IV - DESIGN STANDARDS, and deleting Subsection A.12 of Section IV pertaining to half streets, and substituting therefor the following: 11. Street rights-of-way widths shall be as shown in the Urban Transportation Plan for the City of Corpus Christi (hereafter called "UTP") and where not shown therein, shall be as set forth herein, except that the existing arterial streets shown with 120rights-of-way as of the date of this amendment, including but not limited to Saratoga Boulevard, and its extensions to Rand Morgan Road and Interstate No. 37, Rodd Field Road, Old Brownsville Road, and Yorktown Boulevard, which shall be dedicated by the developers to a minimum width of 120'": k Street Type Urban Arterial Major Thoroudhfare Collector Minor, for apartments Minor, for other residences Marginal Access The subdivider shall dedicate the Right -of -Way Width 100 feet 80 feet 60 feet 60 feet 50 feet 38 feet rights-of-way for streets as required herein, subject to the following limitations: a. If the street is located entirely within the subdivision, the maximum right-of-way to be dedicated by the subdivider shall not exceed one hundred (100) feet in width. b. If the street forms part of a boundary of the subdivision, the subdivider shall dedicate one-half (1/2) of the required right-of-way shown by the UTP, or as stated above, but in no event shall such dedication exceed the lesser of the following: less the sum subdivider (i) fifty (50) feet, or (ii) fifty (50) feet of any rights-of-way previously dedicated to the City by the or his predecessor in title to the property sought to be platted. SEP Z8 1984 MICNEILMED 17249 Where the UTP provides for street rights-of-way in excess of one hundred (100) feet, the City may make mutually acceptable arrangements with the subdivider for the acquisition of the additional right-of-way or may acquire same by condemnation. The subdivider shall construct, at his expense, all streets, or portions of streets included within the plat to the minimum standards specified in Section V -B of this Ordinance, subject to the limitations set forth in the following paragraph. With respect to streets having a designation of "collector", or greater, the obligations of the subdivider with respect to the improvement of same are limited to the following: a. The subdivider shall construct, at his expense, all such streets having a designation of "collector", "minor", or "marginal access" to the standards specified in Section V-6 of this Ordinance, which standards provide for a maximum forty feet (40') of improvements, including pavement, curb and gutter. b. When a street is located within a subdivision and the UTP or this Ordinance requires that such street be constructed to a standard greater than a "collector" street, then the subdivider shall construct, at his expense, such improvements to the standards for a "collector" street as specified in Section V -B of this Ordinance to a width of forty-eight feet (48'), including curb, gutter and pavement. c. When a street is located along the boundary of a subdivision and the UTP or this Ordinance requires that such street be constructed to a standard greater than a "collector" street, then the subdivider shall construct, at his expense, such improvements to the standards for a "collector" street as specified in Section V -B of this Ordinance to a width of twenty-four feet (24'), including curb, gutter and pavement for one-half of a street. d. The City may elect, at City's sole option, to participate with subdivider in the widening, additional paving, additional base, etc., in items a, b, or c above, in which event such costs will be borne by the City. If the property for which a plat is being sought abuts an existing street or an existing street right-of-way which is not improved to the standards set forth in Section V-6 of this Ordinance, then subdivider shall be required to construct, at his expense, one-half (1/2) of the required street; however, in no event shall the subdivider be required: (i) to construct the one-half street to a width of more than 24 feet, including curb, gutter and pavement; or (ii) to construct such one-half street to standards in excess of those specified in Section V -B of this Ordinance for a "collector" street. In the event grades cannot reasonably be established to match an existing pavement at a border street without excessive excavation or lowering of such existing pavement, then subdivider may, should the City Engineer agree that grades cannot reasonably be established, deposit with the City the cost of the border street improvements which would comply with standards specified in Section V -B of this ordinance. Further, in the event such half -street construction herein provided for at border streets is not needed for direct access to properties being platted and is determined by both the City Engineer and Traffic Engineer as not essential to adequate and reasonable traffic circulation in the area, then subdivider may deposit with the City the cost of such half -street construction, which half -street will be constructed by the City in the future coincidental with adjacent development or street construction. SECTION 2. That the Platting Ordinance No. 4168 be amended by deleting Subsection A - Offsite Improvements of Section VI- EXCEPTIONS. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not effect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, word, phrase or provision hereof be given full force and effect for its purpose. SECTION 4. This ordinance shall be effective upon publication one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance stating in substance the purpose, intent, and effect of the aforesaid ordinance.
