BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute the documents necessary for the acquisition of Parcels 3 and 9 for the Washington -Coles Area Unit II Street Improvements Project, all as more fully set forth in the Right-of-Wa ment, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That there is hereby appropriated $1,010 out of the No. 220 Street Bond Fund Project No. 220-77-2.12, Washington Coles Area Street Improvements Unit 2. Gonzales, of the County of Nueces, State of Texas, for and in considera- tion of the sum of Six hundred six dollara and no cents ($606.00) to us in hand paid by the City of Corpus Christi, Nueces County, Texas, and other good and valuable considerations, the receipt of which is hereby acknowledged, have granted and con- veyed and by these presents do grant and convey unto the City of Corpus Christi, Nueces County, Texas, a municipal corpora- tion duly incorporated under and by virtue of the laws of the State of Texas, its successors and legal representatives, the free and uninterrupted use, liberty, privilege; and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas, and being described as follows: Being an irregularly shaped tract of land out of Cabra Street right-of-way adjacent to Block 65, Bluff Portion as shown by map of record in Volume A, Page 3, Map Re- cords, Nueces County, Texas, said right-of-way as re- verted to said adjacent block by Corpus Christi City Ordinance No. 723 dated June 1, 1937 and more particu- larly described by metes and bounds as follows: Beginning at a point on the most northerly corner of said Block 65, Bluff Portion, said point being on the southwest right-of-way line of Cabra, for the beginning point of the tract of land herein described; Thence S. 53° 00' 00" E„ a distance of 30.0 feet along the northern boundary line of said Cabra right-of-way closure, to a point on the centerline of Cabra Street right-of-way; ' Thence S. 370 00' 00" W., a distance of 47.49 feet, along the centerline of Cabra right-of-way to a point; Thence N. 40 43' 00" E., a distance of 56.17 feet to the point of beginning and containing 712.35 square feet of land, or 0.0164 acres, more or less. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, for the purpose of constructing streets, sidewalks, curbs, gutters and appurtenances upon said tract and way for the public use by foot, with automobiles, carts, carriages, and all other vehicles and all other means of transportation necessary or convenient at all times and in all seasons in, along, and upon said tract and way, as well as for laying, repairing, servicing, and maintaining of public utility lines and storm sewers in, on, over, under, and along said tract or way. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives and the public, for the proper use as public streets and utility easements or utility easements for so long as used for such purposes or any of them, and if the use for said tract and way for all of said uses be ever abandoned, then in that event, the aforesaid rights and privileges shall cease, and all rights herein granted shall revert to the Grantor herein, his heirs or assigns.
