HomeMy WebLinkAbout17272 ORD - 09/22/1982AN ORDINANCE AMENDING SECTION 53-55 OF THE CODE OF ORDINANCES BY REVISING THE CITY'S PARKING FINE ASSESSMENTS FOR PARKING VIOLATIONS; PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 53, TRAFFIC, Article III, Division 2, Section 53-55. Penalties, (a), (b), and (c), which provide for minimum fines of $2 and $4, respectively, and double that amount if payment of fines is not made within ten days, be amended by deleting the present categories and in lieu thereof adopting the following provisions: A. That subsection (a) be amended to provide for a fine of not less than three dollars ($3) nor more than two hundred dollars ($200) for violation of traffic regulations. B. That subsection (b) be amended to provide for fine for traffic violation of not less than three dollars ($3) nor more than five dollars ($5), and adding the following sentence: The categories and fine assessments shall apply as follows: Category Fine Assessment After 10 Days Parking Meters and Time Zones: (a) Expired meter $3.00 $5.00 (b) Extending time beyond legal limit 3.00 5.00 (c) Time zones 3.00 5.00 C. That subsection (c) be amended to correct reference to the Revised Civil Statutes, Article 6701d, and to provide for fine for traffic violation of not less than ten dollars ($10) nor more than fifteen dollars ($15), and including the category and fine assessment, said subsection to hereafter read as follows: (c) Unless another penalty is expressly provided by law, every person convicted of a violation of the provisions of Article 6701d, Sections 95 and 96, Revised Civil Statutes, as amended, as adopted by the city council, shall be punished by a fine of not less than ten dollars ($10) nor more than two hundred dollars ($200); provided, however, if the fine prescribed in this subsection is not paid or an appearance is made with a plea entered to have the case heard in municipal court within ten (10) days 17272 MICROFILMED -sEp 2 8 1984 •::. of the date of the alleged violation, then and in that event, said fine shall be not less than fifteen dollars ($15) nor more than two hundred dollars ($200). The categories and fine assessments shall apply as follows: Category Illegal Zones: 1. Loading Zone (Time Extension) 2. Loading Zone (Non -Commercial Use) 3. Parked in Bus Stop 4. Blocking Two Meter Spaces 5. Parking in Taxi Zone 6. Over 18" From Curb 7. The categories and fine assessments shall apply as follows: Category Safety Zones: 1. No Parking Zone 2. Parking Within 15of Fire Hydrant 3. Parking in Fire Zone 4. Blocking Crosswalk 5. Blocking Driveway 6. Blocking Sidewalk 7. Double Parking 8. Opposite Direction of Travel Fine Assessment After 10 Days $15.00 15.00 15.00 15.00 15.00 15.00 15.00 15.00 $25.00 25.00 25.00 25.00 25.00 25.00 25.00 25.00 Unless another penalty is expressly provided by law, every person convicted of a violation of the following category shall be punished by a fine of not less than fifty dollars ($50) nor more than two hundred dollars ($200); provided, however, if the fine prescribed is not paid or an appearance is made with a plea entered to have the case heard in municipal court within ten (10) days of the date of the alleged violation, then and in that event, said fine shall be not less than sixty dollars ($60). The category and fine assessments shall apply as follows: Category Handicapped Parking Zone 1. Parking in Handicapped Space Fine Assessment After 10 Days 2 $50.00 $60.00 SECTION 2. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 3.
