BELLAH FOR DESIGN PLANS AND SPECIFICATIONS FOR A NEW RAMP ON THE BARGE DOCK; APPROPRIATING $16,000 FOR SAID CONTRACT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a contract with Charlie L. Bellah for design plans and specifications for a new ramp on the barge dock at the Corpus Christi Convention Center at 1901 North Shoreline Boulevard, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof marked Exhibit "A." SECTION 2. That there is hereby appropriated $16,000 out of the No. 209 Community Convention Facility Bond Fund of which appropriation $13,500 is for the contract award and $2,500 is for testing services applicable to Project No. 209-76-1.5, Barge Dock Entrance. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall tak effect upon first reading as an emergency measure this the 412/ day of ATTEST: , 1982. /46_2tf_i2e.,0a1442_ City Secretary MAY APPROVED AY OF SEPTEMBER, 1982 /3744,ce J. Bellah hereinafter called "Engineer" agree as follows: I. Services to be Performed: The Engineer hereby agrees, at his own expense, to perform all architectural, structural, electrical, site work design and related studies, estimates and services necessary to properly develop design plans and specifications for a new barge dock ramp at the Corpus Christi Convention Center at 1901 N. Shoreline Boulevard as outlined in the Scope of Services contained herein. II. Scope of Services: The Engineer agrees to perform, for the above named work, professional services as hereinafter set forth: A. Preliminary Phase - Phase I 1. Prepare a preliminary plan indicating a new access ramp from N. Shoreline Boulevard and Hughes Street to the existing barge dock at the seawall at that location. Alternate designs should be considered in ramp selection, as well as overall barge dock parking spaces and ingress/egress considerations. 2. Such preliminary plan shall consider both the removal of the existing ramp and restoration of the existing seawall at the ramp location as well as the effect on the barge dock if the existing ramp were to remain along with the construction of a new ramp. 3. Provide cost estimates for items 1 and 2 above along with other appropriate recommendations concerning both the existing and proposed ramps. B. Construction Documents Phase - Phase II 1. Prepare complete working drawings and technical specifications setting forth in detail the requirements for furnishing and installing the facilities outlined in Article II when so authorized in writing. The Engineer will confer with the City staff during this phase to coordinate the design of the project and incorporate all desired features. 2. Review the cost estimate and advise the City of any changes. 3. Submit to the City Engineer three complete sets of the Documents as outlined in Section 5-1 for review by the City. C. Bidding and Contract Phase 1. Upon approval of the Construction Documents by the City, provide the City with 20 sets of specifications and proposalsand5 sets of plans of the work required in Section B. 2. Provide a list of prospective qualified bidders in the area to the City. 3. Submit a written recommendation of the aWard of the contract to the City. In the event the lowest acceptable bid exceeds the estimated cost, the Engineer shall confer with the City and make such revisions as is satisfactory to the City for the readvertising of bids, without increases in the basic fee. D. Construction Phase 1. Be the City's representative during the construction period which begins with the award of the contract and extends until the final acceptance of the project. 2. Provide the general administration of construction including periodic visits to the site to familiarize himself generally with the progress and quality of the work and to determine in general if the work is proceeding in accordance with the contract. The Engineer will endeavor to guard the City against defects and deficiencies in the work of contractors, but he does not guarantee the per- formance of their contract. 3. Have the authority to stop work whenever such stoppage may be necessary in his reasonable opinion to insure the proper execution of the contract and may condemn work as failing to conform to the contract. 4. Not be required to make exhaustive or continuous on-site inspections normally defined as resident inspection, but will make those inspections necessary to certify that, to the best of his knowledge, work has progressed to the point indicated, the quality of the work is in accordance with the contruction contract, and the contractor is entitled to payment. 5. Review for approval purposes all shop drawings submitted. E. As -Built: Drawings and Maintenance Manuals 1. The Engineer shall furnish to the City, upon completion of said project, or upon termination of this contract as herein provided, a suitable bound copy of the specifications and a reproducible set on mylar, or tracing of the working drawings including any and all corrections, revisions, alterations, or amendments to the plans and/or specifications made during the Construction Phase so as to reflect the true plans and specifications of the building as built. The Engineer shall use 24" x 36" sheet sizes of 3 mil mylar or tracing for the "as -built" drawings which are to be submitted as described above. 3. .The Engineer shall furnish to the City, upon project completion, operating manuals or instructions, parts lists, or maintenance manuals for all mechanical, electrical, or any other equipment installed on the project. 4. The City will not make final payment to the Engineer until the conditions of Section E are met. F. Transfer of Interest The Engineer shall not assign or transfer any interest in this contract without prior written consent from the City. G. Orderly Rendering of Services The Engineer shall furnish the documents required in each phase of the design and personally render or provide the service required in this contract in the sequence and times herein indicated and as may be necessary to insure the prompt and continuous prosecution of the work of designing and constructing the project, and it is understood that all designs and details of designing are subject to the approval of the City, and until the acceptance of results of these services, there shall be no liability on the part of the City for such services.. _ _ The Engineer agrees to furnish items required of Phase I (Preliminary Phase) to the City within forty-five (45) calendar days of approval of date of Contract. The Engineer further agrees to provide Phase II (Construction Documents) within forty-five (45) calendar days of written authorization to begin work in this phase. H. Cost Estimates The Engineer is to provide an estimate of costs at the time of the Phase I or Preliminary Phase submittal as well as with the submission of the Construction Documents Phase, but does not guarantee the accuracy of such estimates; however, the Engineer shall endeavor to design the project so that the cost thereof does not exceed the amount allocated for construction. The City will have the right to require the Engineer to make revisions to the Construction Documents so as tL bring the cost within funds available at no additional fee. III. Compensation: A. Fee Schedule The City agrees to pay the Engineer a fee not to exceed thirteen thousand five hundred dollars($13,500.00) for services for this project. Both City and Engineer agree that fifteen percent (15%) of said fee will be payable upon completion Professional Services Contract Charlie L. Bellah Page 3 and acceptance of the preliminary phase and will constitute full payment for said preliminary phase in the event City does not authorize work beyond the preliminary phase. Should the City authorize the preparation of construction documents for new ramp work and bids are received and a contract for the ramp work awarded, the City will pay the herein stated fee, less that paid through the preliminary phase as indicated herein, as provided for in Section 111.5. following. Should the City authorize preparation of construction, documents and a contract for the work is not awarded, the City will pay the Engineer a sum equal to 75% of the total fee herein stated less the preliminary fee payment as full compensation for all services furnished. For budget purposes, the City has estimated a construction budget of $200,000.00 for this project, exclusive of Engineer's fees, which estimate provides for removing the existing barge dock ramp. B. Payment to the -Engineer:, 1. Upon completion of the Construction Documents Phase in Phase II and acceptance and approval of same by the City, a sum equal to seventy-five percent (752) of the Basic Fee less the preliminary phase payment shall be paid to the Engineer. 2. Upon receipt of bids and award of a construction contract, a sum equal to five percent (52) of the Basic Fee less the preliminary phase payment shall be paid to the Engineer. 3. Upon completion of the Construction Phase, a sum equal to twenty percent (20%) of the Basic Fee less the preliminary phase payment shall be paid to the Engineer. Final payment will not be made to the Engineer until the condition of Article II, Section E is met. 4. In regard to the Engineer's Fee, the parties further agree: No deductions shall be made from the Engineer's Fee on account of penalty, liquidated damages, or other sum withheld from payments to the contractor but the City will not pay the Engineer a fee for change orders necessitated as a result of negligence or omissions on the part of the Engineer. IV. The City reserves the right to terminate this contract at any time with or without cause. In the event of such termination, the Engineer will be paid a sum proportionate to the state of completion of the phase of work in which he is then engaged or work completed as provided for herein.
