AN ORDINANCE
AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR
THE ACQUISITION OF PARCEL 3 FOR THE SPOHN HOSPITAL AREA
STREET IMPROVEMENTS; APPROPRIATING $750; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of Parcel 3 for the Spohn Hospital
Area Street Improvements Project, all as more fully set forth in the the
contract, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated $750 out of the No.
220 Street Bond Fund applicable to Project No. 220-77-2.15 Spohn Hospital
Area Street Improvements.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to preserve and protect public property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passed and shall effect upon first reading as an emergency

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES
THAT Fausto Zarria and wife, Ophelia T. Zarria,
of the County of Nueces, State of Texas, for and in considera-
tion of the sum of Seven Hundred Fifty Dollars and no cents....
($750.00)
to us in hand paid by the City of Corpus Christi, Nueces
County, Texas, and other good and valuable considerations, the
receipt of which is hereby acknowledged, have granted and con-
veyed and by these presents do grant and convey unto the City
of Corpus Christi, Nueces County, Texas, a municipal corpora-
tion duly incorporated under and by virtue of the laws of the
State of Texas, its successors and legal representatives, the
free and uninterrupted use, liberty, privilege, and easement
of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas, and being described as
follows:
Being an irregularly shaped tract of land out of an un-
numbered lot situated at the southwest corner of Block 2,
Shannon Addition, shown by map of -record in Volume A, Page
21, Nueces County, Texas:
Beginning at a point being the southwest corner of said
Block 2 and being the intersection of the north right-of-
way line of Hancock Street and the east right-of-way line
of S. Staples Street;
Thence N. 50 30' W., along said Staples Street right-of-
way 2.0 feet to a point;
Thence N. 840 30' E., along a line 2.0 feet north of and
parallel to the north right-of-way line of Hancock Street,
40.00 feet to a point of curvature of a circular curve to
the left;
Thence along the arc of said curve whose central angle =
6° 45' 29", radius = 339.91 feet, tangent - 20.07 feet, a
distance of 40.09 feet to a point;
Thence S. 50 30' E., 4.36 feet to a point;
Thence S. 84° 30' W., along the north right-of-way of Han-
cock Street 80.00 feet to the point of beginning and con-
taining 183.39 square feet, more or less.'

A map of which is marked "Exhibit A" and attached hereto
and made a part hereof for all purposes.
Together with the free ingress, egress, and regress to and
for the City of Corpus Christi, for the purpose of constructing
streets, sidewalks, curbs, gutters and appurtenances upon said
tract and way for the public use by foot, with automobiles,
carts, carriages, and all other vehicles and all other means of
transportation necessary or convenient at all times'and in all
seasons in, along, and upon said tract and way, as well as for
laying, repairing, servicing, and maintaining of public utility
lines and storm sewers in, on, over, under, and along said
tract or way.
TO HAVE AND TO HOLD, all and singular, the rights and
privileges aforesaid to the City of Corpus Christi, Texas, its
successors and legal representatives and the public, for the
proper use as public streets and utility easements or utility
easements for so long as used for such purposes or any of them,
and if the use for said tract and way for all of said uses be
ever abandoned, then in that event, the aforesaid rights and
privileges shall cease, and all rights herein granted shall
revert to the Grantor herein, his heirs or assigns.
