HomeMy WebLinkAbout17279 ORD - 09/29/1982mb;jd;9/14/82;lst r I; , AN ORDINANCE AMENDING THE PLATTING ORDINANCE, ORDINANCE NO. 4168, AS AMENDED, SECTION V -B (5), THE WATER MAIN EXTENSION POLICY, PROVIDING IN SUBSECTION 5(i) FOR THE EXCLUSION OF WATER POLICY LOT/ACREAGE FEE REQUIREMENTS TO INDEPENDENT WATER DISTRICTS AND PREVIOUSLY PLATTED PROPERTY FOR WHICH THE LOT/ACREAGE FEE HAS ALREADY BEEN PAID AND PROVIDING FOR THE EXCLUSION OF LOT/ACREAGE FEES FOR SUBDIVISIONS OR TRACTS CONTRACTUALLY ANNEXED PRIOR TO JUNE 23, 1982. A NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Amending. the City of Corpus Christi's Platting Ordinance, Ordinance No. 4168, as amended, Section V-6 (5)(c) by deleting the word "use" appearing in the first sentence and substituting therefor the word "zoning"; adding the word 'use" after the word "duplex" appearing in the first clause of the first sentence; and adding the word "zoned" after the words each lot" appearing in the third sentence. SECTION 2. Amending the City of Corpus Christi's Platting Ordinance, Ordinance No. 4168, as amended, Section V-6 (5)(f) by deleting the word "offsite" appearing before the word "arterial" in the first sentence of paragraph I, and deleting the word "offsite" appearing before the word "installation" in the first sentence of subparagraph 1(A). SECTION 3. Amending the City of Corpus Christi's Platting Ordinance, Ordinance No. 4168, as amended, Section V-6 (5)(i) to read as follows: (i) Property which is platted and has existing metered water service and is being replatted for the purpose of changing a building line, easement line, lot line, subdivision name, or for a similar reason will be exempted from the acreage and/or lot fee provisions of this section. If such property has metered service and an additional lot or lots are being created by platting, or if such metered service size is being changed, the provisions of the ordinance will apply to any such lot or lots created. 17279 MICROFILMED -sEp 2 S !,194 , Water policy lot/acreage fee requirements of this ordinance will not apply to property being platted within separate or independent water districts wherein such districts provide water and ensure that fire protection, water extensions, etc., are made to properties within such districts. Further, when the lot/acreage fees have been paid through platting for property, and such property for which fees have been paid is replatted, an additional lot/acreage fee will not be paid except that, if at the time of replatting the land use has changed to where the higher lot/acreage fee applies, the resubdivider will then pay the City the difference in such higher and lower fee rate. Subdivisions or tracts which have been contractually annexed prior to June 23, 1982, will be exempt from lot/acreage provisions of this ordinance for all portions of such subdivisions or tracts for which a final plat has not been submitted, with the further provision that such subdivisions or tracts will not be eligible for reimbursement for water lines constructed or proposed to be constructed. SECTION 4. Severability. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, clause, word, phrase or provision hereof be given full force and effect for its purpose. SECTION 5. Effective date and publication. This ordinance shall be effective upon publication one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance stating in substance the purpose, intent, and effect of the aforesaid ordinance.
