HomeMy WebLinkAbout17284 ORD - 10/06/1982AN ORDINANCE AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE OPTION TO PURCHASE THE GALVAN HOME; APPROPRIATING $79,500 FOR SAID PURCHASE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute the necessary documents for the option to purchase the Galvan Home and other improvements situated on Lots 1 and 2, Block 42, Bluff Addition (403 Waco Street) in connection with the Multi Cultural Center, Project No. 265-77-1, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That there is hereby appropriated $79,500 out of the No. 265 Multi Cultural Center Fund, Project 265-77-1. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient and effective administration of City affairs by executing the aforementioned contract for option to purchase, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed r shall take effect upon first reading as an emergency measure this the 4 day of October, 1982. Prezas, Manuelita G. Oliveira, and the Estate of Virginia G. Gonzalez, herein called Sellers, agree to sell to the City of Corpus Christi, herein called Buyer, who agrees to purchase, upon the terms and provisions hereof, the following described real property, in its present condition, situated in Nueces County, Texas, to -wit: All improvements only situated on Lots 1 and 2, Block 42, Bluff Addition with a street address of 403 Waco and consisting of the main building, garage and garage apartment with all porches and steps, and other site improvements including retaining walls, trees, shrubbery and fences. The total price is $103,750.00 payable as follows: $79,000.00 cash with the balance of $24,750.00 being a donation by the Sellers to the City of Corpus Christi. Buyer agrees to forthwith deposit with Lawyers Title Services, Inc:, the sum of $7,900.00 as Earnest Money, to bind this sale. The Buyer has 90 days to finalize its option to purchase. Sale of this property is to be closed within 90 days from date hereof or this contract and all its conditions shall be null and void. Upon failure of Buyer to exercise its.option to purchase within the specified time period, Sellers may at their option retain the earnest.moneY as liquidated damages. It is further understood that this sale is granted upon the following.conditions: 1. The home is in fact capable of being removed from the current site by the Buyer and relocated to property owned by the City of Corpus Christi. This condition will be verified by the receipt of written bids for said removal. 2. Upon removal of the main structure (Galvan Home), City shall have the right to dispose of or abandon on the premises all other improvements. The City will not be responsible for any damage to the landscape, drives or walks on the property which might occur as a result of the move. Page 1 of 3 3. Sellers shall not be responsible for damage or destruction of the purchased property after the sale is closed 4. Buyer agrees to clean and grade surface of the property which has been disturbed by the moving of the home. 5. The home's primary use will be used as offices, meeting facilities, multi -cultural or multi-ethnic group functions, cultural exhibits, displays, etc. as opposed to being commercial in nature. 6. The City of Corpus Christi and other groups associated with this Multi -Cultural Center project will endorse the recognition of this home as a historical landmark and a historical marker will be placed in front of the home recognizing the contributions of the Galvan Family to th community. home will be called and referred to as the Galvan Home in conjunction with any other name the City may choose with the exception of any other surname. 7. This transaction will be closed by Lawyers Title Service, Inc., and all costs will be paid by the City of Corpus Christi. By Sellers' execution hereof, Sellers acknowledge that they have read this agreement and understand that this agreement is not binding on Buyer until properly authorized by the City Council and executed by the City Manager of the City of Corpus Christi, Texas.
