HomeMy WebLinkAbout17285 ORD - 10/06/1982AN ORDINANCE AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCEL 3 FOR THE FIVE POINTS AREA DRAINAGE OUTFALL PROJECT; APPROPRIATING $900; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute the documents necessary for the acquisition of Parcel 3 for the Five Points Area Drainage Outfall Project, all as more fully set forth in the the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." SECTION 2. That there is hereby appropriated $900 out of the No. 295 Storm Sewer Bond Fund applicable to Project No. 295-77-15, Five Points Area Outfal1, Phase 1. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to take immediate action to preserve and protect public property by expediting the construction of public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall tak ffect upon first reading as an emergency measure this the kk-day of , 1982. Givens, of the County of Nueces, State of Texas, for and in considera- tion of the sum of Nine Hundred Dollars and no cents ( $900.00 ) to me in hand paid by the City of Corpus Christi, Nueces County, Texas, the receipt of which is hereby acknowledged, has granted and conveyed, and by these presents does grant and convey unto the City of Corpus Christi, Texas, a municipal corporation duly incor- porated under and by virtue of the laws of the State of Texas, its successors and legal representatives the free and unin- terrupted use, liberty, privilege, and easement of going in, on, over, under, and along a certain tract of land situated in Nueces County, Texas, and being described as follows: Being a 10 foot wide tract of land out of Tract P, Country Estates Unit 4, as recorded in Volume 30, Page 86, Map Records, Nueces County, Texas, and further described as follows: Beginning at a point being the east corner of said Tract P, and being a point on the westerly right-of-way line of 60 foot wide Emory Drive; 'Thence S. 360 46' 05" W., along said right-of-way 225.00 feet to the point of beginning of this tract; Thence S. 36° 46' 05" W., along said right-of-way 10.00 feet to a point; Thence N. 530 03' 50" W., 290.00 feet to a point; Thence N. 36° 46' 05" E., 10.00 feet to a point for the north corner of this tract;. Thence S. 53 03' 50" E., 290.00 feet to the point of begin- ning and containing 0.067 acres, more or less. Fence to be placed on new R.O.W. line in as was, or better condition, at Grantee's expense. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas for the purpose of construct- ing a public drainage facility, and for the purposes of main- - taining, servicing, repairing, and inspecting said public drain- age facility under, on, and along said tract. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives, for the proper use as a drainage easement and drainage right-of-way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that 'event, the aforesaid y., rights ancl.privileges shall cease.
