HomeMy WebLinkAbout17301 ORD - 10/13/1982AN ORDINANCE AMENDING ORDINANCE NO. 16179 BY ADDING AN ADDITIONAL 0.996 ACRE TRACT TO THE INDUSTRIAL DISTRICT AGREEMENT OF QUINTANA PETROCHEMICAL COMPANY (FORMERLY NUECES PETROCHEMICAL COMPANY), WHICH PROPERTY IS LEASED FROM THE PORT OF CORPUS CHRISTI AUTHORITY, ALL AS SET FORTH IN THE AMENDMENT TO INDUSTRIAL DISTRICT AGREEMENT, A SUBSTANTIAL COPY WHICH IS ATTACHED HERETO AS EXHIBIT 1; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 16179 passed and approved by the City Council on April 8, 1981, be amended to include a revised Exhibit A to the Industrial District Agreement with Quintana Petrochemical Company (formerly Nueces Petrochemical Company) by adding an additional 0.996 acre tract leased by the Company from the Port of Corpus Christi Authority. SECTION 2. That upon written request of the Mayor or five Council members, copy attachsd„ to find and declare an emergency due to the need for efficient and effective administration of City affairs by including an additional tract of land to the aforementioned InduStrial District Agreement, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 1982. The City of Corpus Christi and Company agree that the attached revision to Exhibit "A" consisting of a description and map of an approximately 0.996 acre leasehold tract leased by Company from the Port of Corpus Christi Authority shall be included within and subject to the Company's Industrial District Agreement authorized by Ordinance No. 16179. Company warrants to the City that the use of the subject 0.996 acre tract relates directly to the primary use of the parent tract described under the original Industrial District Agreement. Attached to this memo are three pages from the original lease between our predecessor company and the Navigation District. They are both a metes and bounds description and a plot of the property in question. This property is fenced but there are no improvements on 4. - If further information is required, please advise. TiZ.ACT A OWE • AGREEMENT CONCERNING INDUSTRIAL DISTRICTS THE STATE OF TEXAS ) COUNTY OF NUECES ) THIS AGREEMENT made and entered into by and between tt-e City of Corpus Christi, Texas, a municipal corporation of Nueces County, Texas, hereinafter called "City", and the Port of Corpus Christi Authority of Nueces County, Texas, a political subdivi- sion of the 'State of Texas, situated in Nueces 'County, Texas, hereinafter called "Authority", WITNESSETH: WHEREAS, Ordinance No. 15898, as amended, authorized the designation of certain land areas in the City's extraterri- torial jurisdiction as industrial aistricts; and . WHEREAS, Ordinance Nos. 15949 and 16131 established, designated, and described certain industrial development dis- tricts within the City's extraterritorial jurisdiction; and . WHEREAS, lessees of certain -lands owned by Authority, which lands -are contained in Corpus Christi Industrial Develop- .ment District No. 1 as described in Ordinance 16151, desire to participate in the City's industrial district program; and WHEREAS, the City of Corpus Christi and Authority desire to facilitate the participation of such lessees in the City's industrial district program; NOW, THEREFORE, in consideration of the premises, mutual agreements of the parties herein contained and pursuant to the authority granted under the Municipal Annexation Act (Article 970A of the Revised Civil Statutes of Texas) and the Ordinances of the City referred to above, City and Authority hereby agree as follows: I. . The term of this Agreement shall begin on the first day of January, 1981, and shall continue until December 31, 1987, unless extended for additional period or periods of time upon mutual consent of Authority and City; 11. The City agrees to establish industrial districts with lessees of land owned by the Authority upon submission by each respective lessee, or association of,lessees, and appro- val by the City CoUncil of the City, of a signed industrial ' district agreement, the prescribed form of which appears as Exhibit 1 to Ordinance No. 15898, as amended. 111. The Authority agrees and consents to any land it owns in Corpus Christi Industrial District No. 1 being included in an industrial district agreement between the City and any Authority. lessees, or association of lessees, as described in Article II above.
