HomeMy WebLinkAbout17312 ORD - 10/20/1982AN ORDINANCE AUTHORIZING A LEASE AGREEMENT WITH JOE ROE FOR A TRACT OF LAND AT THE ALLISON WASTEWATER TREATMENT PLANT FOR GRAZING PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a five year lease agreement with Joe Roe for a tract of land at the Allison Wastewater Treatment Plant, for grazing purposes, covering a five year term beginning October 1, 1982, and ending September 30, 1987, all as more fully set forth in the lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." 17312 SEP 2 8 1984 MICROFILMED LEASE THE STATE OF TEXAS I KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES This contract and lease agreement made and entered into this day of , 1982, by and between the City of Corpus Christi, Texas, a municipal corporation, acting by and through its duly authorized City Manager, Edward A. Martin, hereinafter called Lessor, and Joe Roe of Nueces County, Texas, hereinafter called Lessee: WITNESSETH: That for and in consideration of the covenants and agreements herein contained and subject to the provisions hereby, Lessor does hereby lease and demise unto Lessee the following lands and premises: Approximately 9.75 acres of pasture land located in Nueces County, Texas, as shown on the attached drawing. The rental for said property shall be $30.00 per year, payable in advance. Lessee's advance payment of the sum of $240.00 paid pursuant to the terms of lease expired prior hereto, is hereby prorated and applied to the term of this lease so that the rental hereunder is paid in full. 11 The term of this lease shall be for five (5) years, to commence October 1,1982 and to terminate at midnight on September 30, 1987. 111 It is further expressly covenanted and agreed by and between the parties hereto that either party shall have the privilege and right to terminate this lease at any time during its term on giving the other party sixty (60) days written notice, and upon the termination of this lease in accordance with the provisions of this paragraph, Lessee agrees to vacate the premises and shall be reimbursed for the number of months remaining on the annual installment, after the expiration of such sixty (60) day period. IV The property leased herein to Lessee is to be used for the sole and exclusive purpose of grazing livestock. It shall be further agreed exif "/7 that Lessee shall maintain all fences surrounding the property and shall not erect any structures on the premises without permission from Lessor. In the event that Local, State or Federal regulations prohibit livestock on the subsurface injection area (approximately 11.72 acres), the Lessee will fence, or otherwise restrain livestock from such injection area. Lessor shall have the right to inject sewage sludge in any part of the leased area during the term of this lease. ' Executed in duplicate originals this the day of , 1982.
