HomeMy WebLinkAbout17329 ORD - 10/27/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.41, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACTS OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACTS BEING DESCRIBED AS 27.04 ACRES OUT OF LOTS 1, 2, 15, AND 16, SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 27, 1982, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Comission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "AB" Professional Office District should be granted on Tract A consisting of approximately 3.03 acres of land and "A-2" Apartment House District should be granted to Tract B consisting of approximately 27.04 acres of land, being described as a portion of Lots 1, 2, 15, and 16, Section 6, Flour Bluff and Encinal Farm and Garden Tracts; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning of "AB" Professional Office District be granted to Tract A and "A-2" Apartment House District be granted to Tract B of the aforesaid described and hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would 17329 MICROFILMED SEP 28 1084 best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, is hereby amended by adding a new subsection, 31-5.41, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: "Section 31-5.41 The following described tracts of land shall be zoned and classified as follows: Tract A "AB" Professional Office District FIELDNOTES for 3.03 acres of land, more or less, (this description not based on an on the ground survey), out of Lot 16, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, and 43, Map Records of Nueces County, Texas: BEGINNING at a point on the centerline of Everhart Road, same being the Northwest boundary line of said Section 6 for the North corner of this tract from which corner a 1 inch pipe in concrete found at the centerline intersection of Everhart Road and Cedar Pass Drive for the North corner of said Lot 1, said Section 6 bears North 29° 02' 30" East 1320 feet, more or less; THENCE South 600 57' 25" East 300 feet, more or less, for the East corner of this tract; THENCE South 29° 02' 30" West 440.00 feet, more or less, for the South corner of this tract; THENCE North 60° 57' 25" West 300 feet, more or less, to a point on the aforementioned centerline of Everhart Road for the West corner of this tract; THENCE North 29° 02 30' West, along said centerline, 440.00 feet, more or less, for the POINT OF BEGINNING. Tract B "A-2" Apartment House District FIELDNOTES for 24.01 acres of land, more or less, (this description not based on an on the ground survey), out of Lots 1, 2, 15, and 16, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: BEGINNING at a point on the centerline of Everhart Road, same being the Northwest boundary line of said Section 6 for the North corner of this tract from which corner a 1 inch pipe in concrete found at the centerline intersection of Everhart Road and Cedar Pass Drive for the North corner of said Lot 1 bears North 29° 02' 30" East 880.00 feet; more or less; THENCE South 61° 02' 50" East 1,335.79 feet, more or less, for the East corner of this tract; THENCE South 28° 55' 40" West 882.11 feet, more or less, for the South corner of this tract; THENCE North 600 57' 25" West 1037.54 feet, more or less, for a corner of this tract; THENCE North 29° 02' 30" East 440.00 feet, more or less, for an inside corner of this tract; THENCE North 60° 57' 25" West 300.00 feet, more or less, to a point on the aforementioned centerline of Everhart Road for a corner of this tract; THENCE North 29° 02 30" West, along said centerline, 440.00 feet for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take ef ect upon first reading as an emergency measure this the day of , 19 ATTEST: City Se etary MAYOR APPR0VED:27AAY 190P.,4: THE CITY OF CORPUS CHRISTI, TEXAS J.
