AN ORDINANCE
AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 31-5 BY
ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.42,
SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED
TRACTS OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS
CHRISTI, SAID TRACTS BEING DESCRIBED AS THE SOUTHWEST
60.0 FEET OF LOTS 9, 10, 11, 12, 13, and 14 AND THE
NORTHEAST 1/3 OF LOTS 19, 20, 21, 22, 23, AND 24, SECTION
6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR PUBLICATION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning amendment to the text of the
Zoning Ordinance of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday, October 27,,
1982, at Special Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "A-1"
Apartment House District be granted on the west 2,000 feet (Tract A), "AB"
Professional Office District be granted on the middle 800 feet (Tract B), and
"B-4" General Business District be granted on the remainder of the land, all
of which is described as the southwest 60.0 feet of Lots 9, 10, 11, 12, 13,
and 14 and the northeast 1/3 of Lots 19, 20, 21, 22, 23, and 24, Section 6,
Flour Bluff and Encinal Farm and Garden Tracts (Tract C);
(2) That the agreement for the contractual annexation of the land
described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning of "A-1" Apartment House District be
granted on Tract A, "AB" Professional Office District be granted on Tract B,
and "B-4" General Business District be granted on Tract C of the aforesaid
described and hereinafter more fully described parcels or tracts of land; and

WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That Article 31 of the Zoning Ordinance of the City of
Corpus Christi, Section 31-5, is hereby amended by adding a new subsection,
31-5.42, said new subsection to hereafter read as follows, such zoning
classification of the hereinafter described property to be effective upon
annexation:
"Section 31-5.42 The following described tract of land shall be
zoned and classified "A-1" Apartment House District on Tract A, "AB"
Professional Office District on Tract B, and "B-4" General Business District
on Tract C:
TRACT A
FIELDNOTES for 22.95 acres of land proposed for A-1 zoning being the Soutwest
60.00 feet of Lots 11, 12, 13, 14 and the Northeast 1/3 of Lots 19, 20, 21,
22, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which
is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County,
Texas:
BEGINNING at the point of intersection of the proposed Northeast boundary
line of Yorktown Boulevard and the common boundary line of Lots 14, 15, said
Section 6 for the North corner of this tract from which corner the common
corner of Lots 14, 15, 18, and 19, Section 6 bears South 28° 55' 30" West
60.00 feet;
THENCE South 61° 01' 10" East, crossing through Lots 14, 13, 12 and a portion
of 11, with the proposed Northeast line of Yorktown Boulevard, 2000.48 feet
to a point for the East corner of this tract;
THENCE South 28° 58' 50" West, at 60.00 feet pass the centerline of Yorktown
Boulevard same being the common boundary line of said Lots 11 and 22, at
120.00 feet pass the proposed Southwest line of Yorktown Boulevard, in all a
distance of 499.73 feet to a point for the South corner of this tract;
THENCE North 61° 01' 10" West, crossing Lots 22, 21, 20 and ending at the
Northwest line of said Lot 19, 2000.00 feet to a point on the common boundary
line of Lots 18, 19, said Section 6 for the West corner of this tract;
THENCE North 28° 55' 30" East, along the common boundary line of Lots 18, 19,
at 379.73 feet pass the aforementioned proposed Southwest line of Yorktown
Boulevard, at 439.73 feet pass said commmon corner of Lots 14, 15, 18, 19 and
continuing along the common line of Lots 14, 15, in all a distance of 499.73
feet to the POINT OF BEGINNING.
TRACT B
FIELDNOTES for 9.18 acres of land proposed for AB zoning being the Southwest
60.00 feet of Lots 10 and 11 and Northeast 1/3 of Lots 22, 23, Section 6,
Flour Bluff and Encinal Farm and GArden Tracts, a map of which is recorded in
Volume A, Pages 41, 42, 43, Map Record of Nueces County, Texas:
BEGINNING at a point on the proposed Northeast boundary line of Yorktown
Boulevard (120.00 feet wide) for the East corner of this tract from which
corner the point of intersection of said proposed Northeast line of Yorktown
Boulevard and the Northwest boundary line of South Staples Street (400.00
feet from the centerline) bears South 61° 01' 10" East 1125.82 feet;
THENCE South 28° 58' 50" West, at 60.00 feet pass the centerline of Yorktown
Boulevard, same being the common boundary line of Lots 10 and 23, at 120.00
feet pass the proposed Southwest line of Yorktown Boulevard, in all a
distance of 499.73 feet to a point for the South corner of this tract;
THENCE North 61° 01' 10" West, crossing through Lot 23 and a portion of Lot
22, 800.00 feet to a point for the West corner of this tract;
THENCE North 28° 58' 50" East, at 379.73 feet pass the aforementioned
Southwest line of Yorktown Boulevard, at 439.73 feet pass the centerline of
Yorktown Boulevard, same being the common boundary line of Lots 11 and 22, in
all a distance of 499.73 feet to a point on the aformentioned Northeast line
of Yorktown Boulevard for the North corner of this tract;
THENCE South 61° 01' 10" East, along the Northeast (proposed) boundary line
of Yorktown Boulevard, crossing through Lot 11 and a portion of Lot 10,
800.00 feet to the POINT OF BEGINNING.
TRACT C
FIELDNOTES for 12.91 acres of land proposed for B4 zoning being the Southwest
60.00 feet of Lots 9, 10 and the Northeast 1/3 of Lots 23, 24, Section 6,
Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in
Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas:
BEGINNING at the point of intersection of the Southwest boundary line of said
Northeast 1/3 of Lot 24 and the Northwest boundary line of South Staples
Street (80.00 feet wide) for the South corner of this tract:
THENCE North 61° 01' 10" West, along the Southwest line of the Northeast 1/3
of Lot 24 and Lot 23, 1126.29 feet to a point for the West corner of this
tract;
THENCE North 28° 58' 50" East, at 379.73 feet pass the proposed Southwest
line of Yorktown Boulevard, at 439.73 feet pass the centerline of Yorktown
Boulevard, same being the common boundary line of Lots 10 and 23, in all a
distance of 499.73 feet to a point on the proposed Northeast boundary line of
said Yorktown Boulevard for the North corner of this tract;
THENCE South 61° 01' 10" East, along the above mentioned Northeast line,
crossing through Lot 10 and a portion of Lot 9, 1125.82 feet to a point on
the forementioned Northwest line of South Staples Street for the East corner
of this tract;
THENCE South 28° 56' 00" West, along the Northwest boundary line of South
Staples Street parallel to the centerline thereof and 40.00 feet distance
therefrom, measured at right angles thereto, at 60.00 feet pass the proposed
centerline of Yorktown Boulevard, at 120.00 feet pass its intersection with
the proposed Southwest line of said Boulevard, in all a distance of 499.73
feet to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.

SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take fect upon first reading as an emergency measure this the

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
