HomeMy WebLinkAbout17344 ORD - 11/03/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF SAA -81, JOINT VENTURE BY CHANGING THE ZONING MAP IN REFERENCE TO A PORTION OF LOTS 7 AND 10, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS FROM "I-2" LIGHT INDUSTRIAL DISTIRCT TO "B-4" GENERAL BUSINESS DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of SAA -81, Joint Venture for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, November 3, 1982, at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts or parcels of land being described as a portion of Lots 7 and 10, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots situated in the City of Corpus Christi, Nueces County, Texas, be changed from "I-2" Light Industrial District to "B-4" General Business District: Description of a parcel of land, being out of Block 3 of proposed subdivision, "100 South Padre", located in Corpus Christi, Nueces County, Texas, containing 5.0454 acres, more or less, and being out of Lot 7 and Lot 10, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, as recorded in Volume A, page 53, Map Records, Nueces County, Texas. BEGINNING at a 1" iron pipe being the more easterly point at the intersection of the northwest right-of-way line of Old Brownsville Road, a 120' wide road, with the northeast right-of-way line of South Padre Island Drive, for corner; 17344 MICROFILMED. SEp281984 ,r ~ THENCE, with the northeast line of South Padre Island Drive, North 83° 10' 58" West, a distance of 101.09 feet to a 3/4" iron pipe for corner; THENCE, continuing with the northeast line of South Padre Island Drive, North 45° 05' 11" West, a distance of 420.83 feet to a 3/4" iron pipe for corner; THENCE, continuing with the northeast line of South Padre Island Drive, North 40° 50' 16" West, a distance of 52.00 feet to a corner point; THENCE, North 52° 12' 14" East, a distance of 434.68 feet to a point on a curve, the radius point of which bears 'North 65° 42' 52" East, a radial distance of 270.00 feet, said curve being the west right-of-way line of South Enterprize Parkway as proposed in 100 South Padre, Unit 2, a 70' wide street; THENCE, with said west right-of-way line of South Enterprize Parkway, along said curve in a counter clockwise direction, through a central angle of 16° 33' 08" and an arc length of 78.00 feet to the point of tangency; THENCE, continuing with the southwest right-of-way of South Enterprize Parkway, South 40° 50' 16" East, a distance of 464.06 feet to a point of curvature of a curve to the right; THENCE, continuing with the southwest right-of-way line of South Enterprize Parkway, along said curve having a radius of 10.0 feet, through a central angle of 95° 02' 48" and an arc length of 16.59 feet to a point of tangency, said point being on the northwest right-of-way line of Old Brownsville Road. THENCE, along the northwest right-of-way line of Old Brownsville Road, South 54° 12' 32" West, a distance of 313.95 feet to the POINT OF BEGINNING; said tract containing 5.0454 acres (219,778 square feet) of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances 2 3 or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon day of ATTEST: first reading as an emergency measure this the , 19 PZ.
