HomeMy WebLinkAbout17346 ORD - 11/03/1982• ' AN ORDINANCE AMENDING THE ZONING ORDINANCE BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31-5.43 SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS ALL OF LOTS 1, 2, and 3, BLOCK 37, ALL OF BLOCKS 38, AND 39, A PORTION OF BLOCK 45, ALL OF PONTEVEDRA DRIVE, A PORTION OF WHITECAP BOULEVARD, PADRE ISLAND, CORPUS CHRISTI, SECTION H, UNIT 1, BLOCKS 32 THROUGH 45; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, November 3, 1982, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "R -1B" One -family Dwelling District with a Planned Unit Development -1 be granted on all of Lots 1, 2, and 3, Block 37, and all of Blocks 38, and 39, a portion of Block 45, all of Pontevedra Drive, a portion of Whitecap Boulevard, Padre Island, Corpus Christi, Section H, Unit 1, Blocks 32 thru 45. (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; (3) That the permanent zoning of "R -1B" One -family Dwelling District with a Planned Unit Development -1 be granted on hereinafter more fully described parcels or tracts of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would line w SEP 2 81984 MICROFILMED best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, is hereby amended by adding a new subsection, 31-5.43, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: "Section 31-5.43 The following described tracts of land shall be zoned and classified "R -1B" One -family Dwelling District with a Planned Unit Development -1: FIELDNOTES for 18.00 acres of land comprising all of Lots 1, 2, and 3, Block 37, all of Blocks 38, and 39, a portion of Block 45, all of Pontevedra Drive, a portion of Whitecap Boulevard, Padre Island, Corpus Christi, Section H, Unit 1, Blocks 32 thru 45, a map of which is recorded in Volume 43, Pages 47, 48, and 49, Map Records of Nueces County, Texas. BEGINNING at a point on the North boundary line of Whitecap Boulevard (100.00 feet wide) same being the South line of a 38.00 foot wide access road fronting said Whitecap Boulevard for the Southeast corner of this survey from which corner the centerline intersection of said Whitecap Boulevard and Chiclana Boulevard (100.00 feet wide) bears South 01° 16' 30" West 50.00 feet and South 88° 43' 30" East 420.00 feet; THENCE North 88° 43' 30" West, along the North line of Whitecap Boulevard, 475.00 feet to a point for the Southwest corner of this survey; THENCE leaving said North line, North 01° 16' 30" East 521.40 feet to a point for the point of curvature of a circular curve to the left which has a central angle of 26° 00' 00" a radius of 1576.94 feet, a tangent distance of 364.06 feet and an arc length of 715.59 feet; THENCE with said curve to the left, 715.59 feet to a point for the point of tangency; THENCE North 24° 43' 30" West 150.00 feet to a point for the Northwest corner of this survey; THENCE North 25° 22' 06" East 261.56 feet to a point for a corner of this survey; THENCE North 73° 40' 26" East 170.00 feet to a point for a corner of this survey; THENCE South 65° 19' 19" East 188.29 feet to a point for the Northeast corner of this survey; 2 THENCE South 24° 43' '30" East 150.00 the point of curvature of circular which has a central angle of 26° 00 2068.28 feet, a tangent distance of arc length of 938.56 feet; THENCE with said curve to the right point for the point of tangency; THENCE South 01° 16' 30" West 205.61 a corner of this survey; feet to a point for curve to the right ' 00", a radius of 477.50 feet and an , 938.56 feet to a feet to a point for THENCE South 07° 22' 52" West 153.66 feet to the common rear corner of Lots 3 and 4 said Block 37 for a corner of this survey; THENCE South 01° 16' 30" West, along the common boundary line of said Lots 3 and 4, at 125.00 feet pass the Southwest corner of said Lot 4 and crossing said 38.00 foot wide access road, in all a distance of 163.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall takeffect upon first reading as an emergency measure this the Ste 19 fa,. day of ATTEST: Secr Lary AP ROVED: " .iiri.DAY OF (/ldo f , 19( .
