AUTHORIZING THE CITY MANAGER TO SUBMIT A GRANT AMENDMENT
REQUEST TO THE URBAN MASS TRANSPORTATION ADMINISTRATION
TO AMEND UMTA CAPITAL GRANT TX -05-0073 FOR THE PURPOSE OF
REALLOCATING THE REMAINING FUNDS IN PROJECT; AUTHORIZING
THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO
OBTAIN THE AFORESAID GRANT; AND DECLARING AN EMERGENCY.
WHEREAS, the Secretary of Transportation is authorized to make
grants for mass transportation projects; and
• WHEREAS, the contract for financial assistance will impose certain
obligations upon the applicant, including the provision by it of the local
share of project costs; and
WHEREAS, it is required by the U. S. Department of Transportation
in accord with the provisions of Title VI of the Civil Rights Act of 1964,
that in connection with the filing of an application for assistance under the
Urban Mass Transportation Act of 1964, as amended, the applicant give the
assurance that it will comply with Title VI of the Civil Rights Act of 1964
and the U. S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the applicant that minority business
enterprise be utilized to the fullest extent possible in connection with this
project, and that definitive procedures shall be established and administered
to ensure that minority businesses shall have the maximum feasible
opportunity to compete for contracts when procuring construction contracts,
supplies, equipment contracts or consultant and other services:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is authorized to execute and file
a technical amendment to UMTA Grant TX -05-0073 on behalf of the City of
Corpus Christi, Texas, with the U. S. Department of Transportation, to permit
the reallocation of remaining project funds.
SECTION 2. That the City Manager is hereby authorized to execute
and file such amendment and assurance or any other document required by the
U. S. Department of Transportation effectuating the purpose of Title VI of
the Civil Rights Act of 1964.

SECTION 3. That the City Manager is authorized to furnish such
additional information as the U. S. Department of Transportation may require
in connection with the application of the project.
SECTION 4. That the City Manager is authorized to set forth and
execute affirmative minority business policies in connection with the
project's procurement needs.
SECTION 5. That the City Manager is authorized to execute grant
contract agreements on behalf of the City of Corpus Christi with the U. S.
Department of Transportation for aid in the financing of capital assistance
projects.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to obtain federal funds, such finding of an emergency
is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this resolution is passed bpd shall take effect upon first
reading as an emergency measure this the /Q day of November, 1982.

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
