HomeMy WebLinkAbout17362 ORD - 11/17/1982AN ORDINANCE CLOSING AND ABANDONING THAT PORTION OF RESACA STREET FROM THE EAST RIGHT-OF-WAY OF NORTH MESQUITE STREET TO THE WEST RIGHT-OF-WAY OF NORTH CHAPARRAL STREET; REVERTING OWNERSHIP TO ADJACENT PROPERTY OWNERS; AND DECLARING AN EMERGENCY. WHEREAS, a right-of-way exists on Resaca Street from the east right-of-way of North Mesquite Street to the west right-of-way of North Chaparral Street, adjacent to Blocks 61 and 70, Brooklyn Addition, a map of which is recorded in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way with the following provisions: 1. That the ownership of said right-of-way revert to the property owners adjacent to Blocks 61 and 70, Brooklyn Addition, a subdivision as recorded by plat in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas; 2. That all City owned water, sewer, and gas lines in said right-of-way be plugged and abandoned; 3. That all aerial Central Power and Light, Southwestern Bell Telephone Company, and Athena Cablevision cables be removed from said right-of-way; 4. That all underground Central Power and Light Company and Southwestern Bell Telephone Company facilities be removed or abandoned within said right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the right-of-way on Resaca Street from the east right-of-way of North Mesquite Street to the west right-of-way of North Chaparral Street adjacent to Blocks 61 and70; Brooklyn Addition, a map of which is recorded in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas, be closed and abandoned with the following provisions: 1. That the ownership of said right-of-way revert to the property owners adjacent to Blocks 61 and 70, Brooklyn Addition, a subdivision as SEP. d 1984 MICROFILMED.: recorded by plat in Volume A, Pages 2 and 3, Map Records, Nueces County, Texas; 2. That all City owned water, sewer, and gas lines in said right-of-way be plugged and abandoned; 3. That all underground Central Power and Light Company and Southwestern Bell Telephone Company facilities be removed or abandoned within said right-of-way. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find a declare an emergency due to the need for efficient administration of City affairs by closing and abandoning the aforesaid right-of-way such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed ashall take effect upon first reading as an emergency measure this the /7 day of November, 1982.
