CLOSING AND ABANDONING THE 10 FOOT WIDE UTILITY EASEMENT
ADJACENT TO LOTS 6 THROUGH 18 AND THE NORTH 22.84 LINEAR
FEET OF THE FIVE FOOT UTILITY EASEMENT AT THE REAR OF LOT
19, BLOCK 6, DEL MAR SUBDIVISION; AND DECLARING AN
EMERGENCY.
WHEREAS, a 10 foot wide utility easement exists which is adjacent
to Lots 6 through 18 and the north 22.84 linear feet of the five foot utility
easement at the rear of Lot 19, Block 6, Del Mar Subdivision as shown by plat
recorded in Volume 4, Pages 8-10, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said easement, subject
to the following provisions:
1. Applicant construct a sanitary sewer manhole on the existing sanitary
sewer line at the rear of Block 19.
2. Applicant pay the City $1,068.67 as cost for abandoning a 2" gas line in
said easement.
3. Applicant relocate an existing 6" water line in the easement to be closed
to Second Street to connect to a line in Ayers Street to preserve the
looped system and dedicating any necessary easements.
4. Applicant replat Lots 6 through 20, Block 6, Del Mar Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 10 foot wide utility easement adjacent to Lots
6 through 18 and the north 22.84 linear feet of the five foot utility
easement at the rear of Lot 19, Block 6, Del Mar Subdivision as shown by plat
recorded in Volume 4, Pages 8-10, Map Records of Nueces County, Texas, and
shown on the attached Exhibit "A" be closed and abandoned.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find a declare an emergency due to the need for
efficient administration of City affairs by closing and abandoning the
aforesaid utility easement in consideration of the aforementioned provisions,
such finding of an emergency is made and declared requiring suspension of the
Charter rule as to consideration and voting upon ordinances or resolutions at

three regular meetings so that this ordinance is passed and shall take effect

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
