AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31,
NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW
SUBSECTION, 31-5.45 SETTING FORTH ZONING CLASSIFICATION
OF SAID AREA OF LTD DESCRIBED AS A PORTION OF LOTS 1, 2,
3, 14, 15 AND 16, SECTION 11, FLOUR BLUFF AND ENCINAL
FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of Raymond 0.
Haubelt, Jr. for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Monday, December 6,
1982, at Special Council meeting of the City Council in the Council Chamber
at City Hall in the City of Corpus Christi; and the City Council further
finds as follows:
(1) That the Planning Commission of the City of Corpus Christi has
found the proposed change in zoning is in the public interest and within the
purpose of the zoning ordinance; and, that permanent zoning of "R-2" Multiple
Dwelling District be granted Tract 1 and "B-4" General Business
granted on Tract 2 on a portion of Lots 1, 2, 3, 14, 15 and 16,
Flour Bluff and Encinal Farm and Garden Tracts, Nueces County,
fully described hereinafter, be granted;
(2) That the agreement for the contractual annexation
District be

described herein to the City of Corpus Christi does not contain any condition
of rezoning said land by the City Council, and that such contract contains no
reference to zoning;
(3) That the permanent zoning as hereinabove set forth be granted
to the aforesaid described and hereinafter more fully described parcels or
tracts of land; and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendments
would serve public health, necessity and convenience and the general welfare
of the City and its citizens:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, is amended by making the change hereinafter set out.
SECTION 2. That there is hereby amended Article 31 of the Zoning
Ordinance, Section 31-5, by adding a new subsection, 31-5.45, said new
subsection to hereafter read as follows, such zoning classification of the
hereinafter described properties to be effective upon annexation:
"Section 31-5.45. The following described tracts of land shall be
zoned and classified as follows:
Tract 1
"R-2" Multiple Dwelling District on the follwing more particularly
described tract:
DESCRIPTION of a 9.71 acre tract of land, more or less,
being portions of Lots 2, 3, 14, 15, and lfi, Section 11,
Flour Bluff and Encinal Farm and Garden Tracts, Nueces
County, Texas, said tract also being the southeasterly
portion of a 20.00 acre tract of land recorded in Volume
1720, Page 905, Deed Records, Nueces County, Texas:
BEGINNING at a point in the northeasterly property line
of said 20 acre tract from whence a 5/8" iron rod at the
northwest corner of said 20 acre tract bears N -61° 00'
00" W, 862.35',
THENCE: With said northeasterly property line S 61° 00'
00" E, 447.45' to the northeast corner of said 20 acre
tract for corner;
THENCE: S 29° 00' 00" W, 665.28' to the southeast corner
of said 20 acre tract for corner;
THENCE: With the southwesterly property line of said 20
acre tract, N 61° 00' 00" W, 1111.37' to a point for
corner;
THENCE: N 29° 00' 00" E, 276.19' to a point for corner;
THENCE: S 22° 02' 45" E, 412.72' to a point for corner;
THENCE: N 67° 57' 15", 545.50' to a point for corner;
THENCE: N 29° 00' 00" E, 224.40' to the point of
beginning, containing 9.17 acres, more or less.
Tract 2
"B-4" General Business District on the following more particularly
described tract:
DESCRIPTION of a 10.29 acre tract of land more or less,
being portions of Lots 1, 2, 15, and 16, Section 11,
Flour Bluff and Encinal Farm and Garden Tracts, Nueces
County, Texas, said tract also being the northwesterly
portion of a 20.00 acre tract of land as recorded in
Volume 1720, Page 905, Deed Records, Nueces County,
Texas.
BEGINNING at a 5/8" iron rod in the southeasterly
right-of-way of South Staples Street, an 80' wide road;
THENCE: With the northeasterly property line of the
previously mentioned 20 acre tract, S 61° 00' 00" E,
862.35' to a point for corner;
THENCE: S 29° 00' 00" W, 224.40'
THENCE: S 67° 57' 15" W, 545.50'
THENCE: N 22° 02' 45" W, 412.72'
to a point for corner;
to a point for corner;
to a point for corner;
THENCE: S 29° 00' 00" W, 276.19' to a point in the
southwesterly property line of the previously mentioned
20 acre tract for corner;
THENCE: N 61° 00' 00" W, 197.85' to a 5/8" iron rod in
the southeasterly right-of-way line of South Staples
Street, said point also being the southwest corner of
said 20 acre tract;
THENCE: With said right-of-way line of South Staples
Street, N 28° 57' 00" E, 665.28' to the point of
beginning, containing 10.29 acres of land more or less.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from
time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this the

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is,
introduced, or at the present meeting of the City Council.
