HomeMy WebLinkAbout17377 ORD - 12/06/1982a AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF ORPHIE NEATHERY, III, BY CHANGING THE ZONING MAP IN REFERENCE TO ANCHOR HARBOR TRACT I FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT ON TRACT A AND "A-2" APARTMENT HOUSE DISTRICT ON TRACT B; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Orphie Neathery, III, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Monday, December 6, 1982, at Special Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on the hereinafter described tracts of land described as Anchor Harbor Tract I, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Tract A and "A-2" Apartment House District on Tract B: Tract A FIELDNOTES FOR proposed R-2 zoning of 4.90 acres, more or less, out of Anchor Harbor Tract No. 1, a map of which is recorded in Volume 30, Page 83, Map Records of Nueces County Texas: BEGINNING at a point on the Northeast boundary line of South Padre Island Drive (State Highway 358) for the South corner of said Anchor Harbor Tract No. 1 and the South corner of this tract; i?377 SEP 2 81984 ii,i1CROFiLHER THENCE North 63° 36' 30" West, along said Northeast boundary line, 125.13 feet, more or less, for the West corner of this tract; THENCE North 29° 00' 00" East, leaving said Northeast boundary line, 1711.61 feet, more or less, for the North corner of this tract; THENCE South 61° 00' 00" East 125.00 feet, more or less, for the East corner of said Anchor Harbor Tract No. 1 and for the East corner of this tract; THENCE South 29° 00' 00" West 1705.92 feet, more or less for the POINT OF BEGINNING. Tract B FIELDNOTES for proposed A-2 zoning of 9.88 acres, more or less, out of Anchor Harbor Tract No. 1, a map of which is recorded in Volume 30, Page 83, Map Records of Nueces County, Texas: BEGINNING at a point on the Northeast boundary line of South Padre Island Drive (State Highway 358) for the South corner of this tract from which corner the South corner of said Anchor Harbor Tract No. 1 bears South 63° 36' 30" East 125.13 feet, more or less; THENCE along the abovmentioned Northeast boundary line as follows: North 63° 36' 30" West 31.93 feet, more or less; North 67° 54' 00" West 200.44 feet, more or less, and North 63° 36' 30" West 44.16 feet, more or less, for the West corner of said Anchor Harbor Tract No. 1 and the West corner of this tract; THENCE North 29° 00' 00" East, along the Northwest boundary line of said Anchor Harbor Tract No. 1, 1386.34 feet, more or less, for the North corner of said Anchor Harbor Tract No. 1 and the North corner of this tract; THENCE North 69° 15' 00" East, 125.00 feet, more or less, for a corner of said Anchor Harbor Tract No. 1 and a corner of this tract; THENCE North 59° 54' 00" East, 300.00 feet, more or less, for a corner of said Anchor Harbor Tract No. 1 and a corner of this tract; THENCE South 61° 00' 00" East 40.17 feet, more or less, for the East corner of this tract; THENCE South 29° 00' 00" West 1711.61 feet, more or less, for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the ,4 day of `FC_ ATTEST: , 19S2 .
