HomeMy WebLinkAbout17383 ORD - 12/08/1982• AN ORDINANCE • AMENDING THE PLATTING ORDINANCE BY REPEALING ORDINANCE NO. 17249 PASSED ON SEPTEMBER 8, 1982, IN ITS ENTIRETY AND REINSTITUTING TO FULL FORCE AND EFFECT SUBSECTIONS A.11 AND A.12 OF SECTION IV AND SUBSECTION A - OFFSITE IMPROVEMENTS OF SECTION VI -EXCEPTIONS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 17249 passed on September 8, 1982, be repealed in its entirety. SECTION 2. That Section IV, Subsections A.11 and A.12. and Section VI -Exceptions, Subsection A -Offsite Improvements, be reinstituted to full force and effect to read as follows: "Subsection IV, Design Standards, A. Streets, 11. Street right-of-way widths shall be as shown in the general plan for the City and where not shown therein shall not be less than as follows: Street Type Right-of-way Width Major Thoroughfares Collector Minor, for apartments Minor, for other residences Marginal Access 80 feet 60 feet 60 feet 50 feet 38 feet Section IV, Design Standards, A., Streets, 12. Half Streets shall be prohibited, except where essential to the reasonable development of the subdivision, lot, or lots in conformity with the other requirements of these regulations and where the Commission finds it will be practicable to require the dedication of the other half when the adjoining property is platted. Wherever a half street has already been provided adjacent to a tract to be platted, the other remaining half of the street shall be platted within such tract, in accordance with Section VI, A, of this ordinance. Section VI - Exceptions. A. Off Site Improvements. Where any street forms any part of the boundary of a subdivision and some part of the width of said street has been dedicated or committed to dedication, the subdivider will be required to dedicate such additional amount of the land necessary to provide the street easement required to conform to the design standards set forth in Section IV of said Ordinance No. 4168 from the area lying within land owned by him. And if the part already dedicated or part MIORok ja_ 17383 SEP 2 8198D • already committed to dedication is improved or committed to improvement, then the subdivider shall be required to improve the balance of the width of any such street to correspond with previous improvements and commitments to improve; otherwise no improvements shall be required as a prerequisite to the approval of the plat for any existing dedicated street forming a boundary of a subdivision." SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the immediate need for efficient and effective administration of City affairs by repealing Ordinance No. 17249, such finding of an emergency ,is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passedp and shall take effect upon first reading as an emergency measure this the I lay of December, 1982.
