AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR
THE ACQUISITION OF A PARCEL OF LAND FOR CONSTRUCTION OF A
PROPER TURN RADIUS AT FIVE POINTS IN CONNECTION WITH
STATE CONSTRUCTION ON U.S. 77; APPROPRIATING $12,600; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of a parcel of land for construction
of a proper turn radius at Five Points in connection with State construction
on U.S. 77.
SECTION 2. That there is hereby appropriated $12,600 for
acquisition of the abovementioned parcel from Streetnd Fund applicable to
Project No. 220-77-73.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
take immediate action to preserve and protect public property by expediting
the construction of public improvements, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that this
ordinance is passed and shall take effect upon first reading as an emergency
measure this the 1r day of December, 1982.

THAT BILLY D. BRUNSON AND STEPHEN W. DEAN, VENTURERS IN A JOINT VENTURE CALLED

to us in hand paid by the City of Corpus Christi, Nueces County, Texas, the re-
ceipt of which is hereby acknowledged, havg granted and conveyed and by these
presents do grant and convey unto the City of Corpus Christi, Nueces County,
Texas, a municipal corporation duly incorporated under and by virtue of the Laws
of the State of Texas, its successors and legal' representatives, the free and
uninterrupted use, Liberty, privilege, and easement of going in, on, over, under,
and along a certain tract of land situated in Nueces County, Texas, and being
described as Follows:
Being 0.042 acre of land, more or less, out of the Gregorio Ferias Grant, Abstract
592 and being a part of Lot G-3 of the Magee Tract Annex as recorded in Volume 29,
Page 84 of the Map Records of Nueces County, Texas and being a part of the same
land described by Deed recorded in Volume 1571, Page 632 of the Deed Records of
Nueces County, Texas; said 0.042 acre of land being more particularly described
by metes and bounds as follows:
Beginning at an inside corner on the south property line of the said Lot C-3; from
said point the southeast corner of said Lot G-3 bears S. 30° 37' E., 5.0 feet and
N. 59° 23' E., 279.94 feet;
Thence S. 59° 23' W., a distance of 51.16 feet along the south line of said Lot
G-3 to the P.C. of a curve to the right;
Thence in a northwesterly direction along a curve to the right, a distance of
22.80 feet to a point; said curve has a radius of 10.00 feet and a radius point
bearing N. 30' 37' W., 10.00 feet;
Thence N. 10' 00' E., a distance of 48.25 feet along the existing east right of
way line of U. S. 77 to a point;
Thence S. 57' 50' 53" E., a distance of 59.76 feet to the point of beginning and
containing an area of 0.042 acre of land or 1,829.52 S.F., more or leas.
A map of which is marked "Exhibit A", and attached hereto and made a
part hereof for all purposes.

gutters and appurtenances upon said tract and way for the public use by foot,
with automobiles, carts, carriages, and all other vehicles and all other moon, of
transportation necessary or convenient at all times and in all seasons in, along,
and upon said tract and way, as well as for laying, repairing, servicing, and
maintaining of public utility lines and storm sewers in, on, over, under and a-
long said tract or way,

singular the rights and privelenes afore-
said to the City of Corpus Christi, Texas, its successors and legar representa-
tives and the public, for the proper use as public streets and utility easements,
or utility easements for so long as used for such purposes or any of them, and if
the use for said tract and way for all of said uses be ever abandoned, then in
that event, the aforesaid rights and privileges shall cease, and all rights here-
in granted shall revert to the Grantor herein, his heirs or assigns.
